This last week we received a call for a listing appointment, we were asked for a price that we believed the home would sell for...we gave them that price and listed the home.  We had an open house down the street the next day and brought 3 groups through both homes.  The next day we had an offer on their home (the new listing).  

We represent both parties, seller and buyer, and we have told them both that we have a fiduciary duty to both;  

I would love to hear your input on representing buyer and seller.

As long as you disclose you should be fine legally. I try to aviod that situation and partner with someone else in the office. This way each party is equally represented.

It depends on your buyers and sellers; if it's been disclosed to both parties and both agree, it's OK. However, sometimes I find it's best to refer the "newest" party to another agent in a different brokerage.

In my state dual agency is legal with the informed consent of all parties. But you'll get people who would never engage in it and debate the practice ad nauseum. 

Nothing wrong with getting both sides; I do from time to time, but typically the buyer is told I work for the seller.
