Have You Ever Been Reported To The Real Estate Commission

I have NEVER been reported to the Real Estate Commission.  I have Realtor friends that have been reported.  The complaints were frivilous, but it is still disturbing.  You have to stop in your tracks and address the complaint no matter how unfounded it maybe.  One friend of mind had a complaint and she replied to it within the Commissions time frame.  Unfortunately, the commission lost the reply and threatened her with hefty finds and sanctions for not replying.  She had to go in front of the commission and prove that she replied.  It seems like when you are summoned by the commission that you are guilty until proven innocent.  I know that the RC wants to protect the public.  Who protects us from the public?

Vicky, the system works.  It's not perfect, but state license commissions do a very good job of separating the frivolous complaints from the valid ones.

What amazes me is that the public doesn't take the time to check and see if their prospective agent has a history of license violations.  I've seen agents who continue to practice with a history of multiple violations and the public is completely unaware.

We are professionals, and in theory the public is not. So you as a professional are able to protect yourself right or wrong. Get use to it and make sure that you always cross the 't,s' and dot your 'i,s'. Disgruntled agents are more likely the problem than the public.

I have known agents that I am amazed that they still have their license.  I have known as many good agents that did nothing wrong to end up defending themself to the  commission.  I watch every word to not get trapped in any violation.  I fill out every disclosure and cover myself constantly as if I was in a fish bowl.  I have a friend that had a house listed.  The sellers allowed the buyer to move in before closing ( I know that was a mistake).  The buyers loan fell apart and the sellers asked them to move.  The buyer reported the listing agent to the commission. That is not a disgruntled agent that is a spitful buyer.

Vicky, it's true that complaints sometimes come from a spiteful buyer or a competitor with an agenda.  But the state commissions that deal with these complaints are very good at distinguishing between reality and nonsense.  The burden of proof is generally on the party that brings the complaint and that is where the vast majority of these things come apart.

One of my present clients actually filed a complaint against an agent and when the commission called him, he hung up on them! Uh, not a wise move!
