Foreclosure mediation program sees limited success just 18 months into it's start. Out of 102 cases in 18 months only 14 reached settlements. Because NH is a non judicial state which means teh court does not have to hear the foreclosure case, the program has been voluntary and lenders have been slow to participate.

Things do look like they are changing though as judges are now ordering court ordered mediation on both parties. If a borrower asks the court for an injunction putting off the foreclosure, if the judge agrees the borrower meets the standards for granting an injunction, the jusdge can refer the borrower and the lender to mediation. Mediation relies on trained volunteers to mediate an agreement between parties and is provided free of charge.  

If you are a home owner and are behind in your mortgage, it is important to have communication with your bank. Ask for the home retention department, collectors are there to collect but home retention is meant to listen to your problem and offer choices to assist you. The longer you wait, the less choice and chance you may have.

There is many programs to help you stay in your home if you have the ability to make any type of payment. If you have no ability to pay, a short sale may be the best option for you. if you live in NH, please feel free to contact me for more information on how a short sale works and how it may help. A short sale has no upfront costs to you. Many sellers have their shorted amount forgiven, the negotiator can let you know if you can do this as well.
