Tax Grievances - Mark your Calendar for 2012!!

If you missed the deadline to file a tax grievance this year, it may still work out well for you.

The dates used by the Board of Assessment Review and Small Claims Courts to determine their assessed value for your property for this year were July 1, 2009 - July 1, 2010.  That time period includes a few months during which the Home Buyer Tax Credit was in place - and it slightly skewed the prices at which property's sold.

Next year's tax grievances will use the dates of July 1, 2010 - July 1, 2011 - which means two things.  1) The Tax Credit time period is no longer included, and the prices of properties in many areas have been in a decline so if you get an appraisal done, it may come in lower than it would have for this year.  2) AND - since July 1, 2011 is already past - we could actually tell you even now what you're property would appraise for as of the required effective date of a tax greivance appraisal of July 1, 2011.

So - Mark your calendar and call your local Appraiser to get an appraisal done for your 2012 tax grievance.  Remember - you don't have to use an appraisal for your tax grievance, but it can often help your case considerably.  However, for a tax grievance if you want to use an appraisal to show your opinion of your property's value you can ONLY use an appraisal that was done as of the previous year's July 1 effective date - AND the appraisal must have been done for the "purpose of" reviewing your tax assessment, or for "tax grievance" purposes.  You can't use an appraisal that was done for the purpose of settling an estate, or selling a property.  At least, not in NY State.  The appraisal has to be one that was done specifically for the purpose of grieving your taxes.

Hi Jean, It's great to be prepared for those tax grievances. This year dates have passed for most counties, but residents can start now to be ready for 2012.
