The Perfect "Dual" Agency!

Earlier I wrote about representing buyer and seller.  Asked for other's opinions.  This happens more often with "teams" that have multiple agents and it may not be looked upon as dual agency, but it is...even as it is with listing and selling agents both working for the same broker; which is dual agency to the broker. 

I have been in the business, in and out, since the mid 1970's and so much changes and yet so little really changes.

Laws change, documents change and our adherance to both must be followed.  Ever since the mid 70's my ethics remain and continue and always will...the client(s) always come first, honesty and rightful disclosure, treating every client as I would want to be treated myself, working for a win, win transaction.  

We are still in the same dual agency transaction as when my first blog went out asking for input.  This has been one of the most blessed transactions I have ever been a part of.  Needless to say the property is perfect, the seller is wonderful and blessed and the buyers are so special.  The buyers knew every property on the market for the last 6 months better than most Realtors.  And all the Realtors who had listings and open houses in this beautiful community knew them.  

While working through this offer and acceptance I learned some things that we all need to keep in mind.  We had the only offer and the seller had countered at full price.  Another agent (who knew the seller) called the seller direct and told her she had a client who wanted to make an offer.  Our seller called us and told us to tell our buyer that there was another agent with a buyer who wanted to make an offer the next day.  (That agent had been showing the property when we were there with our buyer...and that agent called us too to say she was going to be writing an offer.)  We said nothing to our buyer until our seller called us and said she wanted us to tell our buyer.  We told our buyer...left them to think about it...a half an hour later they called us back.

Our buyer knew the value of the property and accepted the counter at full price.  It is always a pleasure working with clients who are well aware of the market and of value.  It makes it so much easier to give back!

This has to be the "Perfect" dual agency transaction!

And the added blessing...so far...as there may be many more...was the home inspection and inspector.  After a most perfect inspection we had the priviledge of learning more about our seller and our client's inspector...medical miracles that broke my heart and at the same time filled it with joy!  This is why I love my work!

Bonnie Jean:  I don't mean to be harsh, here... but this "other agent" who called your seller... regardless of whether she knew the seller or not... I would absolutely, without a doubt, lodge a formal ethics complaint against her with your local board, Association, or MLS.  If any agent called the seller on one of my listings... honestly, that is what I would do... after, of course, I notified her office manager, and the owner of her brokerage office.

In spite of that... I am glad that your dual agency sale worked out well.  Here in Texas we have what is called an intermediary relationship which allows to work with both a buyer and a seller on a transaction... although we are seen as an "intermedary"... rather than seen as representing either one.

By the way... I have been an agent since the mid-1970's as well... and yes, things have changed... just a tad.  <smile>

You are correct, this other agent should not have contacted our seller but in this case it worked against her and her client.  There is a fine line that we must follow to adhere to the law and there is wisdom we must use to be the best agent for our client's best interest.  

As an example:  If she had not said anything to anyone but met with her clients the next day and written an offer, our buyer may have countered to the seller at less than full price.........then it would have been anyones game.

It's a rare thing to have such a well behaved seller and buyer.  Dual agent makes me nervous from a liability standpoint but I'm glad it's working out for you.

Bryan, Dual agency should not make us nervous as long as we serve all our clients equally and with the fiduciary duty we owe them all!  As I am sure you do!

Bonnie, subscribing to my blog is easy.  First, click on my name listed below at the bottom of this comment box.  That will lead you to my profile page.

Then... over on the left side of that page... you will see a link to My Blog.  Click on that... which opens you up to the first page of my blog... and all my posts.

On the right-hand side... beneath my picture... is a link in a box that says Subscribe to Blog.  Click on it, and you are "subscribed to my blog."

Then... whenever you get on Active Rain, and click on the word "blogs" at the very top of the page... another page will open up.  It is the "blogroll."  Along the left side is a list of each newly-written blog post... as they are written.  Along the right will be a list of each person whose blog you have subscribed to... with the person who has written a blog post most recently... listed first.

Dual agency works quite well - it has for me. I don't sell that many of my own listings but when I have the transaction went smoothly. As long as all parties understand our role and we adhere to our fiduciary responsibilities there shouldn't be any issues
