Kris I truely wish you were in California or maybe it don't matter but here is my night mare and then I have more of someone elses to share with you.

we got our home from my mother in law when she died in 2004 here in this house that thyey have had since 1967. My husband and I got it through a living trust. The house was appraised at that time ot $306,000. We refinanced it only to $90,000. so we could make it bigger for our family to live in. Well we had no idea what we were doing and on our own so we ran out of money before it was finished. This was in 2005. Our neighbor is in real estate so she got us a second loan and we had no idea any thing about loans or lenders. But she got us a loan with a private lender name Barry Cooper in Encino CA for $50,000. he did no credit checks or checked to see if we worked or anything. The loan was solely on the equity we had in our house. Well then in early April 2007 I was having some help problems so I had to give up my job as a care giver for the state. Then later that same month my husbnand and his boss of 12 yrs had a falling out and my husband walked off the job so we had no income at all all of a sudden. We had already made the payments for April. In early June we received a card from Barry Cooper saying that if our payment was not made by June 12, he was starting foreclosure. We must have talked to him before then because nothing was files then. Some time between June and early July 07 Barry Cooper called us and asked us about out payment not made yet. We explained to him that we had no income coming in at the time and we did not know what we were going to do yet. So he offered to rewrite our loan from $50,000. to $70,000. we thought about it and believed that there would be enough money from the rewrite so we could buy into a friends business so we could have some income then. Well when we finially got the money thtat was left from the rewrite there was only $3,500. sent to us. The rest went to several different places but more than one time the document shows BarryCooper was paid out of this for different reasons. to shorten the story some In Nov 07 my husband was laid off from another job and in Jan 08 Barry Cooper started foreclosure. In Feb 08 we called him to tell him we had the money we were behind with him and we were in the proceess of getting our first loan modified. Barry Cooper told us that he would only take it out of foreclosure if we paid him all of what we were behind with him and Litton. this was he said $6,900.00 Well we did not have that kind of money. So then in March because my husband had not gone back to work yet Litton would not give us a modification till we had a job. We talked to them and they said that we had to have one payment in by March 2, 08 or they would foreclose too. We sent the payment but they got it one day to late and they sent it back because they started foreclosure on March 2, 08 too. The my husband went back to work and I tried to get online with Litton Loans to check out our history and status but I could not get in . it said I was not authorized to get in. At that point I  began believing that Litton was in cahoots with Barry Cooper to take our house because of the equity in it.In April 08 I was searching Barry Cooper on line and found that in 1999 he had been in trouble with theFTC for Asset Lending and other predatory lending practices. He was on probation for 5 years and had tpo repay money. No This was what he did to us in July 07 when he offered us more money that he knew we could not pay back or he made sure we could not pay him back that is. And I made a complaint by phone to FTC about him again. Then I went to the Sacramento (I live in Calif) County recorders office to look at our file and found that the foreclosure with Litton had been rescinded on March 37, 08 and I did not understand why we were not notified of this. When I got home I called Litton and they said that our agent had paid it up for us. Come to find out it was Barry Cooper that paid this and he was keeping the payments current till we got the sale date on our door.the date was 5-7-08 to be sold at auction. Still no notice from Litton or Barry Cooper that we were no longer in foreclosure with them. We were able to on our own file bankruptcy prior to the sale date by 2 days. As we had no idea what to do with the Bankruptcy or how to fill out the papers properly on Sept 30 2008 the judge dismissed our bankruptcy. We believed mistakenly I guess that we still had about 60 days before they could take our house. Well On 10-9-08 Barry Cooper wrote us a letter telling us that our house had been sold to the investers at the auction on 10-7-08 and basically what were we going to do about moving. We were devestated. Then a week later we got another letter from Barry Cooper saying that he was in the process of putting our house back intto our names. We I later found out that it wa sstill in our names till 10-22-08 so I knew Barry Cooper was playing some kind of game but I did not understand it. Then I decided to write a letter to the people now on our deed and lay my heart out to them about letting us buy back somehow our house because we knew he was not going to be living in it. I also let him know what a bad personm Barry Cooper is hoping he was not the same way. Well a few days later this man called me and said that he wanted to help us get our house back and that he was will ing to put it back into our names but he did not want to worry that we would sue him later. I assured him we could work out something and why would we sue him,? He said he did nt know but he did not want to have to worry about that. i said no problem. He then said that because they had not been paying the first loan for a few months that we needed to work with Litton to get that all caught up and a loan modified then after that we would discuss some kind of arringment that we could afford. But that the house would have to be put back into our names before Litton would do this hje said. I told him that we just got papers from Litton for another loan modification and we only had till 11-21-08 to have these papers back to them and this was the Middle of Nov already. We hung up and just a few minutes later jhe calls me back and said that he wants me to sign somepapers that will say that we will not sue him or Barry Cooper before they put the house back in our names. Well I did not agree but I did not disagree but he told me to have our attorney to call Barry Cooper the next day so we can get this done soon because barry Cooper told him that I refused tio talk to him which was a lie. The attorney he was talking about has been helping us as a go between sorta because Barry Cooper wouldnot talk to me and so thi sattorney called him for us. I could not reach the attorney that day so I called Barry Cooper myself the next day. He pretty much said the same thing the invester said the day before except at the end he said that he would only put it back into our names if we would sign a liability release for him his invester and the trustee seller he said. I told him that I did not care aboiut his buddies but that I could not do that for him because I had already been making complaints about him and they were going to keep going. Then he would not talk to me he said and I said then talk tio our attorney. Well then the date passed that we could get the loan modified because he still had not put the house in our names. Then on Dec 1 I sent overnight registered a proposal from me to Barry Cooper that basically said thatI would sign anything he wanted as long as he rewrote another loan but this time making our &70,000. loan amount his new respoonsibility. That he was going to be in lots more trouble this time around than last time for sure. Well he got tjhison 12-02-08 and on 12-03-08 the house was back in our names but he never told us tillbe faxed to the attorney copies of this rescission for the default then the sale too. But never contacted us about it as yet. now there is more I just as getting boggled and I still have more to tell about another woman he is with the help of his invester literally kicking her out of her home of 40 year s this was her parents home as well in Riverside Cal. She is Helelna Jett and 64 years old. She in 2007 only wanted a reverse mortgage and she met a woman who was a friend of her who rents a room from Helena who is also a foster parent. They all became she believed good friends. This womans name is Tyra who was a real ator for 10 years. She told Helena that she was working on getting her a reverse mortgage and in the mean time she knew a investment place that temporarily would for $30,00 plus would pay helelna monthly payments. Well to shorten her story this Tyra had stollen this plus more money when she got the loan through Barry Cooper for $260,000. approx and $170,000. went to pay off the other loan and then the remainings was stollen by this tyra woman and after Helena found this out she took her to court and won the judgement but then the woman left town and no one knows where she is. Then Helena was trying to still work this out with anoither lady who said that he was like a daughter to the lender Barry Cooper and she will fix what ever had not been done right by Tyra. Well this woman also lied to Heklena and she is not even a realator she lied about that too. The next thing Helelna knows was that when she got home one day after picking up some foster kids she cam,e home to find a 5 day get out notice on her door by the sherroifs. She had no idea what that was all about. So sher went to the court house and she learned that she was being evicted from her house in 5 days. She lives on a fixed income and has some health issues from the Tyra thing and now she is absolutlky beside herself with what she can do and how she will do it. She has no money because she can not even take in any foster klids with this eviction over her head and the emotional  issues she had had to endure from these horriblely greedy people has been very trying and tramatic for her as an elder woman this has had a long lasting effect on her health and her credit. She has 18 legal defences for the eviction and when she went to court last month for this the judge continued it for 30 days because she wss not properly served. But the attorney she paid $4000,. to go and help her that she had to borrow was not there he sent someone else and then thshe goes back to this court on Jan 16, 09. I plan to drive there and try to do what ever possible to help her but we are at a loss and so exhausted from searching and thinking and we just don't know what we have missed because how couyld this even be possible?. Please if you can help or even if you can not let me know so I know that you recieved this at all. Thank so much sorry its so long but this is just some of what the horror we have bneen living with due to greedy people who already have more then we do but wants that too. Help please Donna Cox
