Should a Seller disclose EVERYTHING? Not always!

Crazy Woman with crazy collender on her headShould a Seller disclose EVERYTHING? I used to think so, until I listed CW's* home. "I can't fill out the Transfer Disclosure Statement", she said. "If I do no one will buy this home".

"REALLY??"  I'm thinking mold in the attic and a dead body in the backyard.

"So, what's wrong with it?"

"Well, we get turkeys jumping on our roof... TURKEYS! They're terrible. And planes fly overhead.  I've even seen helicopters."

"Really", I say. "What else".

"The neighbors.  They are terrible.  I hate them".

"Uh hmm... What else".

"I've seen termites fly out of the ground before... behind our fence. And there are spiders.  Lots of them.  And bugs. They're awful.".

"And I hate this neighborhood."

"No kidding".... This woman is nuts, I think. This is one of our best neighborhoods - very much in demand.

Now, she is not certifiably nuts.  She is a working professional, and makes a lot of money. But she is nuts in the Sally Dunbar Book of Character Assessment.

"Ya know, those items are all PREFERENCES", I tell her. "They are not disclosure issues.  Every Fair Oaks neighborhood has turkeys.  And we live in nature and nature has termites. And spiders. And bugs. We just disclose if they are eating our house. We only disclose factual issues that effect our home - not preferences."

And, I think, a nut job like you would be a disclosure issue for the neighbors if THEY sell! Imagine living by her!  As it turns out the neighbors had a block party when she moved. She had quite a reputation as a CW... Crazy Woman. And I developed a new cocktail named after her.  It ends in "Slammer", cause that's what I wanted to do this entire escrow.

But we made it through the transaction. Amid unbelievably controlling behavior at the escrow signing, and antics I could write a book about, we closed the deal. Now the new owners are loving the wonderful neighbors, photographing the turkeys, and appreciating their beautiful new neighborhood.

I have them follow the questions on the disclosure. I do think that excessive airplane noise could be a disclosure, and also the turkeys? animal pests? Not sure about the rest.....ugh

Ok, turkeys on the roof is a new one!  You are one brave soul and I expected to read something other than your blissful ending.  Any story that ends with a closing has a blissful ending.

At least you have turkeys!  We have turkey vultures in our neck of the woods.  Really nasty looking birds. But more importantly, I want to know where I can buy a "Hat" like the one the woman in the picture in your post is wearing!!! LOL

What I tell the sellers regarding disclsoure is this: Obvioulsy anything pertaining to the property such as a material defect must be disclosed and that is required by law. As far as "other issues"; if you feel that that is something that you would have wanted disclosed to you when you were buying a property, then you should probably disclose it. If you think a reasonable buyer would be influenced in the decision making by knowing or not knowing the fact, you should probably disclose it.

 

My rule: disclose, disclose, disclose.  (say it 3 times like location).

 

Sellers only get in trouble for not disclosing enough. No seller has ever been in trouble for disclosing too much.

Failure to disclose the presence of invasive wildlife and the fact that the subject house is under a frequently used flight path could lead to a very unhappy buyer and possible court action. Stranger things have happened.

#26 does not believe that a pedophile living across the street (a registered sex offender???) is a disclosure issue?

Great post. Iv'e heard some strange sayings but i've never heard the term "Turnkey jumping off the roof" To funny. We here in So Calf. would love to pic k and choose what to disclose but by law we must disclose it all.

Sally, I am hoping that the picture in your post was of your crazy-woman seller, and not of YOU after this women got through running over you with all of her "concerns."  We deal with such "interesting" people, don't we ?
