Happy End Story. And It Is Not Christmas Yet.

In Florida (and in Colorado) we are presumed acting as Transaction Brokers unless stated otherwise.

On AR I noticed the attitude that transactions brokers are sort of half-a$$ agents or brokers as we do not have to offer full fiduciary and that makes buyers we work with not clients but customers.

The belief that a piece of paper signed will make me half a$$ is very foreign to me. I am sure there are half-a$$ agents in any state. By the same token I am sure that there are good agents in Florida and Colorado.

Like so many others, I try to do a good job. My last closed short sale took 2 years, 6 months and 25 days. The last (6th) buyer, represented by another agent, sent me an e-mail and requested that I work with him directly.

I turned to the agent, but he said that it was fine with him. The Buyer is an experienced real estate attorney, very precise, very focused... I could say «No», but I was not born yesterday, and in a challenging transaction, I knew that my chances to close a deal with a delegating agent were not the greatest, and I either do it, or risk losing yet another buyer.

So, I worked with both Seller & Buyer the way we work as transaction brokers with both sides. In addition with the short sale stuff, I was involved in the financing for the Buyer, and insurance issues with the condo. I kept the other agent informed by copying him on the e-mails. Funny, in 2 years, 6 months and 25 days we exchanged 839 e-mails. Whew!

After the closing I sent congratulations to both. Here is what they sent me. This is from the Buyer, with whom I worked for the last 2 months:

Jon,

Thanks for your kind note.  I realized early on that the success of this transaction would be based on you and I sheparding it through the process.   You are a terrific broker and I would be pleased to refer clients to you in the future. 

And this is from the Seller, with whom I worked for over 2.5 years:

Jon, what a relief it is to finally receive this message.  I’m so very thankful to you.  Most agents would have given up long ago, but your support never wavered.  Most agents would have hit brick walls and been turned away.   Not you, you ran right through the walls.  Your knowledge, expertise, tenacity and support have been remarkable throughout this long process.  I will always be indebted to you.  For such a long time, I have felt as if there was a huge boulder over my head that could drop and crush me at any time.  Thanks to you, the boulder is gone;  and I can, as you said move on with my life.  You are a remarkable man Jon, and I am very fortunate to have had the opportunity to work with you. All the best to you and your family.

It is not to pat myself on the back (even though I am so humbled by these e-mails). It is to show that yes, it is possible to do a good job for both parties. 

There is no law that would make a bad agent a good agent. As there is no law that would make a good agent a bad agent. The law does not turn customers into happy clients in the sense that we imply. It is what we do and how we do it that matters.

After all, this is a happy end story...

And it  is not yet Christmas...

Again Jon when your clients want to work with you specifically because of your due diligence and knowledge, it is a huge plus (would they say feather in your cap?) for your reputation ....which will stay with you...nicely done.

Jon - That is the reason I work with many short sales because I feel I am doing something for people to get on with their lives and take the "monkey" off their backs.

Well done, and well deserved praise and thanks from people who know how hard it is to close a short sale from start to finish and what an accomplishment is is to know you helped a fellow citizen out of the mess of this housing crisis.

Jon,

You know the very idea that agents should be anything, but fiduciaries appalls me.

But, this pales in comparison to fiduciary brokers with 20 to 30 page sales agreements that disclaim their that fiduciary!

Transactional brokers may be a poor choice, but their honest!

I'll take an honest agent every time.

It always comes back to: "The only protection the consumers have is the personal integrity of their agent!"

Kristen - I understand you. Here it was funny. When I got the e-mail from the Buyer, I told the other agent that I do not like the idea, and he said that it was fine because the Buyer was a Real Estate Attorney and knew everything. And I told him that he may know his stuff, but what about COE in that case?

I told him that I could do it if he would give it to me n a referral basis, and I would pay him double the usual referral, but  the  idea of losing a penny did not warm the agent, so I feel like for the most part it was a referral where the other agent has received the full commission.

No, I do not complain. It was a matter of selling it.

I think the main focus is that the result and appreciation all of the parties involved is what's most important, not the customer vs client designation.  In Manhattan, we don't have a lot of buyer brokerage agreements so I can understand your thoughts on how some people feel that is such a big deal.  Business is completed differently all over and you have to work within the transaction in front of you and complete it as best as you can.

Hi Jon..wow, I too am impressed with you hanging in there for your clients that long..it says a great deal about your character. As long as you are there to look after your clients and protect their interest, it doesn't and shouldn't matter what title you hold. I've worked with both good and bad..and they've all called themselves REALTORS®. Congrats on a job well done.

Jon you must have the patience of a Saint.  All that time invested in one deal.  I would have been worn out.

In my state representing both parties is dual agency.  I also just finished one.  I had a buyers agency and my client decided to buy a FSBO.  I certainly did not want to get thrown into this it just happened.  I usually prefer not to do a dual agency.  It can get complicated.

I do agree with you, that a good agent who is mindful of the middle road can do an excellent job for both parties.

Congrats on sticking with it and getting 'er done.

Jon, congratulations on your tenacity.  In NC we do practice Dual Agency.  We make sure our buyers and sellers understand it clearly and completely before we ever begin.  In 8 years there has never been an issue.

Jon, congratulations indeed you seem to have a tremendous work ethic and that helps in almost all deals. I agree with others laws don't make anyone better or worse why else do we have murderers walking the streets. I enjoy reading your post they are always enlightening.
