Responding to Offers

Ok...I'm a bit hot under the collar and I don't even have a collar on!  I called on Friday evening to one of the top teams with CB.  I spoke to the wife of the husband and wife team.  I asked for a Sellers Disclosure on a property and told her we were submittinb an offer on Saturday morning.  She asked for my fax and said she would send it over.  By Saturday morning I still didn't have the Seller's Disclosure and called and left a message again and that I was meeting my client at 10:00 AM.  I never received a call back.  I met my client at the local Starbucks and he signed all papers for the offer.  I faxed over the offer.  I called and left another message that I had faxed over the offer.  No reply.  It's Sunday and I just emailed the listing agent.  My buyer wanted a call by 5PM today regarding the offer.  My offer was low - I know it was low but that is what my buyer wanted to offer.  I told the listing agent it was low however my buyer deserves the same treatment as a higher priced offer.  This home has been on the market for 153 days and has changed realtors several times.   

In the email I sent, I asked them to contact me asap.  I was not mean but focused.  How can you treat another agent this way especially when they are putting in an offer on one of your homes that has been sitting there.  Evidently, this sale is not that important to them. 

What are your thoughts?

Sharon, I have noticed that many agents in our area do not work on the weekends.  It irritates the "everything" out of me.  That's also why there is a place in the offer to say you have not received the disclosure and the seller has so many days to provide it once executed. 

But, you also must realize that maybe the sellers told their agent not to respond to you.  We must do what our clients tell us to do, and if a seller says not to call until Monday to see what happens over the weekend, you cannot call.  I've been on the receiving end of this a couple of times, and I was just put on the other end last week where I couldn't call the buyer's agent.  I did answer the phone when the buyer's agent finally called me to check on things, and all I could tell her was that I have not been "allowed" to call her per my seller's instructions.

Donna, thanks for your input.  It helps me to see a different side.  The offer might have insulted the sellers but I also have to do what my buyers wanted.  It is just irritating! And not work weekends?  That's when most of the offers I have come in.  Maybe I need to manage my time better!

Shucks, I'd have delivered it directly to the broker with a note that the agent isn't communicating and would they please present my offer although it is incomplete because we haven't been able to get the disclosures.

That's exactly what I'd do and have done.  Funny how quickly the agent gets on top of things.  Of course if the listing agent is also the broker, you're out of luck and just go find another house.

You said it was a top team, and if that is the case I would be pretty surprised if they worked weekends.  But still, its not that hard to check the emails and respond to the agents on a saturday or sunday night.  What does it take, an hour max?

I agree with you completely Sharon.. just breath deep and see what Monday brings.

Lenn, just to clarify, even without a disclosure notice, the offer is complete.  On our Texas contracts, there are three choices when it comes to the disclosure: we've received it; we haven't received it and give it to us within so many days; you're not obligated to provide one to us. 

But I also know, most of the brokers in this area are hands off and we all run our own business, and most brokers aren't going to present anything to a seller, though they might call the listing agent and let them know they received an irrate call and they better call the other agent asap... though the Dallas side is slightly different than the Tarrant County side of how some agents and brokers run their business...

This type of behavior can be irritating, and unfortunately it is all too abundant.

It should give you an indication though (at least from what I have experienced) ... that this type of behavior will probably last throughout the transaction.

It is a good heads up that you will probably be playing baby sitter with this particular Realtor.

Hi Sharon:  If the Listing Office is pretty close to you, I would have gone over there in person and spoken with someone.  Also, that would have given you the chance personally to pick up a copy of the Seller's Disclosure.  I would probably also follow it up with a call to the office manager, or the broker on Monday.  It appears that the Listing Agent does not know she is mistreating her own seller by failing to act.  If I can be of help, please call me.  :)

Sharon, I agree with you. Many agents some new and some more experienced are not following the rules of the road. This cost us all business. Return calls and fax over disclosures. Just remember this one, you will get paid at the end of the day. The listing agent is the one who wont be in business very long.

Ok..in fairness to the listing agent..I got an email from the Mrs this am saying she did fax over the Sellers Disclosure on Friday and has a receipt.  She also said the Buyer had been out of town this weekendl.  This would have been nice to know so my buyers wouldn't have been on pins and needles the entire weekend.  All it would have taken was a phone call.  I did hear from another agent that this team does not work weekends.  All I ask for is common courtesy.  We need to treat each other like we would like to be treated.  All I can say is I would hate to be a client of this team.

Unfortunately Sharon..this is happening everywhere...I don't know what is up with people any more.

How on earth don't you work weekends in this business?I couldn't be a client either of theirs.

Locally here,you have to go through a call center with CB to set up things...just frustrating.....hope things work out with your offer!
