Tammy I can’t imagine that would hold up in court. I would have the home owner’s lawyer talk to her home owners associations lawyer.
Wow. I'm guessing it must be some type of gated community? Hard to believe a challenge to that would stand up in court either if someone wanted to press the issue.

HOAs often come up with their own set of rules and unfortunately, some of the ridiculous by-laws do seem to cause more harm than good ( to anyone but the governing body of the HOA) We had a situation near us where an HOA told a resident he had to remove his American Flag from his yard because it was too large and they thought the flag pole was an eyesore. He is a veteran and refused to remove his flag. The incident did end up in court... the Veteran won!

I have had this experience in Arizona, where my in laws lived in a senior community of modular homes. No Realtors allowed! The community did however, have someone on site to assist buyers with showings and contracts.

Tammy, Let's hope this strange and over-reaching rule doesn't gain in popularity. It certainly doesn't benefit the homeowner.
Tammy....always important to read those rules & regulations first. I would think this would be a deterrent for people considering buying there!
I've seen many HOA's in my area that wont' allow certain size real estate signs, but prohibiting REALTORS® all together seems a major violation of one's personal rights.

I agree that this probably will not stand up in court. Imagine the liability the HOA is imposing on the home owner, by not allowing them to use a qualified professional to help them through the process. Not to mention the buyer's right to representation. Nope, I don't see it standing up in court if someone wanted to push it.
Seriously - in reading your article we all seem to have the same reaction - it will never stand up in a court of law. What is a little overwhelming to me, not only in this situation but many similar ones, is the desperation that one must feel three years later when your house doesn't sell! UGH
It is an odd situation. I don't know all the details as we just host her website she created JUST TO SELL HER HOUSE. Poor gal!! I too would be at my wits end. I'll ask if there is something more she can do. Thanks for all the comments! :)
Wow. Do they get to mow their own lawns, paint their own houses and put new roofs on themselves? Do they have to mend their own fences, pour their own concrete and fix their own plumbing leaks? If the home owners can hire professionals to do any of the above, then not allowing real estate agents to help them sell their home is discrimination. And the last time I checked, that was against the law.
You would think, eh!? Crazy!!
