Background:

Showed a couple from Long Island several homes in Ocala & Marion County Florida over 2 days last November.  They flew back to Long Island and asked me to prepare an offer.  Here in Florida that means filling out a purchase and sale contract (10 pages) and getting buyer to sign before submitting to the listing agent.

Outcome:

A few days later the buyer calls, mad as can be.  He has talked to his attorney who claims that I was asking his client to sign a contract, not an offer!  The buyer refused to work with me, called another agent who works the same area.  That agent worked out an offer and agreement and closed the deal.

Learning:

After discussing with my broker, I learned that it is customary in New York to have a one page offer letter prepared and presented.  After acceptance, a contract is prepared and signed.  I have closed several deals with clients from other states since then.  Now I always ask and explain how we plan to do it and have never lost another one!

I have prepared a few 'Letters of Intent" for buyers--especially on larger purchases as they often want their attorney and/or financial adviser to know their intentions before they 'ink the deal' and enter a contract.  You're right, it is a good idea to explain the process and ask how they wish to present their offer--good lesson for us as we move toward a more global practice of real estate.

I knew different states did title and closing differently but I didn't know about the letter of intent.... I definitely can see how you could lose clients if you don't understand their customs....

Bob -- That's the pits. Guess you couldn't fall back on a buyer agreement either.  When these things happen, consider it a learning experience that will never be repeated....or forgotten.
