A new County law regarding disposable carryout bags provided to customers at certain retail establishments will take effect on January 1, 2012. Montgomery County passed legislation (Bill 8-11) on May 3, 2011, that places a five-cent charge on each paper or plastic carryout bag provided by retail establishments in the County to customers at the point of sale, pickup or delivery. Starting January 1, 2012, all retail establishments in Montgomery County that sell goods and provide their customers a carryout bag (either paper or plastic) are required to charge 5 cents per bag.

The following are examples of bags that are exempt under the law (click link below to see the full list):
- Bags used to hold prescription drug(s);
- Bags sold for initial use as yard waste bags, pet waste bags, garbage bags, dry cleaning bags, or newspaper bags
- Bags provided by a seasonal stand or street fair stall, such as a farmer’smarket, yard sale, or “occasional retailer” (defined in the law as “…a retailestablishment that engages in the retail sale of goods no more than six daysin any calendar year);
