It is ALWAYS your Choice Who To Use As Your Realtor
I received an email today from someone I care deeply about. She tells me that she is sorry. She saw a home on line, and sent an email inquiring about an open house. The broker was at the property and why doesn't she come on down. Well, they did, and needless to say fell in love with it.
Her email told me that she had to move quickly and prequalify through the listing agents mortgage people or they would lose the home. They are signing P&S today. 
She tells me that she is sorry, that they didn't have a choice! I have not, nor will I ask for details. I don't want to rain on their parade, but...
You always have a choice.
Clearly they didn't have representation. Did they know they should have? Did they know they could have? You know I won't know. I suspect they knew exactly what they were doing or got so caught up in the emotion of it that they acted hastily.
If you are buying a home, you should always have representation! I can't think of many, really, any exceptions. Especially in the situation I have described above. I've been in the business for 24 years. If I were buying a home, I would get an agent, someone other than myself. It is just that important!
Buying a home is an emotional purchase. I don't know many people that act rationally when emotions are involved.
Because you are family or friends, do you have to use me? No.
You always have a choice in who to use as your Realtor! But do make a choice!
The listing agent works for the Seller. That means their obligation is to them. Literally. Their job is to get the best deal for the Seller. Just because they are friendly, nice and smiling, doesn't mean that your best interests will be theirs!
Will you lose the home because you have an agent? Will you get a better deal without someone representing you? I highly doubt it! Don't go it alone or fall prey to the listing side because they tell you that you must act quickly! Pick up the phone. Hire a Buyer's Agent. It doesn't cost you a dime and you know what? It is expected!
Acting in the best interest of your family would be leveling the playing field and getting someone to work for YOU!

I had a guy call me this week as he searched the internet and found our site, found a house he liked our MLS search,asked me to show him the home, then told me he was going to call a realtor to represent him. He thought the home was my listing. I had to explain it was not my listing. WE wrote an offer tonight.
I wished I could hit the "Like" button after every second. You're right on your gut feeling. They knew exactly what they were doing but they chose to put their emotion in their way.

I understand how senitive a subject such as you describe is -- there are a couple of questions that I wonder about, did you have a buyer brokers agreement, also did the other agent that made this sale inquiry about your clients having representation?
I am a fan of buyers brokers agreements, friend, family, or stranger, I do not leave home without one. Happy Holidays.

Here's the key to the situation and it's a direct quote from your post: Buying a home is an emotional purchase. I don't know many people that act rationally when emotions are involved. They got caught up in the moment and forgot any rational knowledge they may have had about buyer's representation. My guess is that you'll be "counseling" her in the months to come as she's going to be at the mercy of the seller's agent. She'll definitely be a client of yours at some point in the future.

Congratulations on the featured post..well deserved. We have all been there at one time or another in our real estate careers. I'm sorry this happened and know it is disappointing to you. The important thing to do is learn from this occurrence..could you have done anything differently? Did you have a buyers agency agreement with them? Were you actively in the process of showing them homes? Was this home located in an area not mentioned to you? Where you in constant communication with them or were they just begining process or not serious yet? There maybe wasn't a thing you could have done as they got caught up in the moment..but it might be worth while to ask those questions to see if with a future client this situation could be avoided. Carol Ann, I could not agree with you more. Buyers should definitely seek their own representation as things can get very complicated otherwise. For the sake of your friends, I hope this turns out well.

As a licensed broker and attorney, I definitely would not get another agent when personally engaging in the purchase or sale of property. That said, it appears that your "clients" were railroaded by the listing agent.

Sad that they psyched out your buyer to buy without representation and made them feel they were going to lose out. This is why it is so important that we try and educate as many buyers as possible so that they understand that having a buyers agent is the best decision they can make!
