About Declaration of Homestead

By
Real Estate Agent with Province Real Estate

Nevada state law requires property ownership to be made public.  With this in mind, once your purchase of a Las Vegas or Henderson home is recorded by the Clark County Recorder's office, the information is public and you will likely be solicited by opportunistic companies wanting to take advantage of your desire to protect such a significant purchase.

About Declaration of Homestead ~ By recording a Declaration of Homestead, you effectively protect some or all of the equity in your home from general creditor claims* (your equity is not protected against all claims, such as child support or tax liens- read the law or speak with an attorney to understand your rights.)  In the state of Nevada, the amount that is currently protected is $550,000.  Simply stated, if you were sued by a creditor, the first $550,000 you have in equity in your home is protected and cannot be liened.

The Clark County website provides additional information and the document required to record the Declaration of Homestead on your property.  If you do not want to record the document yourself, you may elect to use the services of local companies who perform this function on your behalf.  Chances are that you will receive multiple offers for this immediately after your purchase becomes public record.

On a final note, please know that my services don't end after a closing.  Feel free to contact me if you have any questions regarding the closing package you receive from the title company, general solicitations in the mail, etc. and you can continue to take advantage of my local real estate and transactional knowledge.
