Does John McCain Want To Shut Down The Blogosphere?

Businessman Tied Up Unable To Do BusinessSenator John McCain (R-Arizona) has created quite a stir with both negative words about the blogosphere and more importantly, with legislation that could affect it. I'm sure the political blogs, which have been around longer than most blogs, have irritated politicians from the get-go. The Drudge Report and Slate have been thorns in the sides of Presidents for several years now. The first thing McCain did to irritate bloggers was a speech he gave at Jerry Falwell's Liberty University. He basically said (and I paraphrase here) that bloggers are egocentric windbags who do not listen to nor take the opinion of others. For his actual words, here are two links: The National Review and a blog site called Think Progress. Lest you think this is a non issue, When the Think Progress Blog posted McCain's remarks, they got 267 responses.

The next issue deals with sexual predators. And child porn. No, this is not a non sequitur. John McCain has introduced legislation that is aimed at serious restrictions on blog sites. Mostly those with open commenting abilities. He and his Bill say that sexual predators and child pornographers can post on our sites so therefore we should all be responsible for checking out the commenters on our posts. ?????  The bill also seems to hit on some other issues that may actually be legitimate, like illegal use of copyrighted material on blogs. The sobering aspect is the penalty phase: up to $300,000 in fines. Can you spell N-A-P-S-T-E-R? If you are interested in reading the legislation itself, here is a link to the Bill.  It sounds to me like the legislation would require us, or at least the hosts (hello Matt and Caleb) to police their sites in such a way as to turn up and turn in illegal websites, user ID's etc of posters and commenters. Maybe someone else can explain it differently, but that's how I read it.

This has hit the blogworld by storm. Much posting and commenting!  Stephen Frug on Blogspot. I found out about it by lurking on a local Cleveland Blog called Brewed Fresh Daily (which definitely should have been my title how dare they lol). They referenced a site called Boing Boing which got me to other McCain posts as well.

When you get a chance, you might want to read about all this. Some of the comments on the posts talk about things like First Amendment Rights violations, free speech gags, penalties for violations on the sexual predator side of this argument that might cause most people to shut down their blogs.

The 'egocentric windbags who do not listen nor take the opinion of others' referred to us bloggers and yes, we do have that right as does everyone else. 'Something' needs to be done but binding all of us up or penalizing all of us is not the answer, IMHO. I personally still do not consider McCain a windbag but he is working hard to change my opinion lol   Thanks for the comment Norm.

Given that "WE" have just been voted Time Magazine's "Man of the Year" does that put us on the good side. How can McCain speak ill of the Man (woman) of the Year?

Of course, we all know that the sexual predators, spammers and scammers are a major problem, and it would be great if there could be a way to control them. Probably can't happen when they're global and we're national.

Elaine, hiya  and for sure we can't control them; but as far as our blogs are concerned, maybe we don't know who the predators are but we have editorial control over comments. Now I am a big proponent of free speech, so it would be hard for me to delete, but there still could be a circumstance that would cause it. Dunno. John McCain I think needs to regroup lol

Three of my grandaughters are young (8-14). I agree with free speech also, up to the point that it might harm my girls. Then I become a "mamma bear". :-) I made sure my daughter has eSORN and checks it every now and then, as they live in a small rural town.

But see Elaine, that's the point. Parental control. People can still write whatever they want, but your daughter has the ability to control what her children see - that is how I think it should work; and even adults, we can read it or turn the page or click onto a new page; I really feel we have to protect First Amendment Rights. I can see it easy for John McCain to send out the possey after Caleb and Matt and the AR gang, but how are they going to go after each of us with our own blog on our own website?  How rediculous.  I may be Republican but this is just stupidity on his part.  If he was smart enough to have his own blog he'd probably be able to run again (successfully) for the White House.  I have to think there's a huge untapped political support and candidate platform area in blogging?

I haven't commented on your blog before this, but it's good to see you didn't blow away with the AR wind storm - you were AWOL Saturday...

Hi Gabriel, boy did you read my mind on that stuff. I think there is an amazing 'blog lobby' to be tapped, by target marketing, for politicians. And I'm sure this is not news to them. Maybe just to John McCain, although something tells me even he is aware of it. Ty Gabriel I guess the glitches got worked out, no worries.

I'm wondering though: do we all need to contact our elected officials, since this is now a 'real' Bill? Just to let them know how we feel.

Lets take this one step further, isn't this just another politician sounding off becuase he doesn't like what is being posted personally. How long before legislation appears and the searhc engines are told what they can and can't list and in what order. We all know the Gergge Bush 'Miserable Failuare', the Tony Blair 'Liar' and Dalton McGuinty of Ontario and the 'Pointy Headed Liar'. So should these entries be removed becuse they are also people's opinions and may offend some people.

All too often the truth hurts and things do offend us, but get a grip Politians thats life. If you can't take the heat get out of the fire. What ever hsappened to FREE SPEECH !!!!!

Rob: the whole point about Free Speech is to protect the speech that the majority does not agree with. I agree with you, and sometimes it seems like we all need to be reminded of that fact.

Carole, this is all very interesting and somewhat challenging. From a copyright standpoint, there are obviously lots of issues, many of them real. I see it here on the Rain everyday. Some bloggers are very good about giving credit for information in their posts and others appear to be pretty lazy about it. Who is ultimately responsible? If I had my way, it would be the individual blogger. I'm all about personal accountability, but legislation like this may make it possible for copyright owners to go after ActiveRain Corp. regardless of their disclaimer. That could be a scary proposition. I think it's much ado about nothing in the end, however. I can't see how this will fly. 

That said, he should be afraid of the the blogosphere. The power is shifting. We are becoming the press.

Jeff the copyright issue is something else, I agree. And that should be handled like any other violation of the law; but in my opinion, laws already exist to handle copyright infringement, yes? We all need to police ourselves about that. But the rest of it is ....baloney lol

Carole, you are 100% correct. Copyright laws already exist to fully handle any Internet instance of copyright abuse and it's our responsibility to police ourselves. Even the little images folks grab off other's websites to highlight thei posts can be considered copyright infringement, however. Some of the habits will be hard to change.

Hi Leanne: welcome back from your trip. It would be too simple and too unlike Congress to have it just be about copyright....but then again we already have copyright laws lol.  Jeff AND Leanne: I am usually too shy about taking photos anywhere else except clip art; When I do, I add acknowldegements about where they are from; but I worry about forgetting, so usually stick with clip art; yes I guess that makes me a chicken! Unless I take the photos myself of course

Carole, love your posts.  You've always got something worth reading. 

As a newbie to blogging I'm thinking like Ines.  I will never have time to go further than ActiveRain.  Why, I don't have time to start my own blog just reading all the great stuff everyone else puts out. =)  Apart from that bit of fluff, however, I agree with the general concensus that they'll never be able to eradicate blogging.  It's way bigger than anyone could have ever imagined.  Interesting though that they would try.
