Caveat Emptor
This word comes from the Latin "Let the buyer beware" The buyer must examine the good or property and buy at his/her own risk. This was once an accepted rule. Homebuyers in Colorado have much more protection now than before about this matter. as sellers and brokers are required to disclose problems or face possible penalties.

Esta palabra viene del latin "Caveat Emptor" El comprador debe de examinar los bienes o la propiedad y comprarla bajo su propio riesgo o asumiendo el riesgo que puede implicar una adquisicion de una propiedad en el estado de Colorado. Ahora las regulaciones en bienes raices en el esado de colorado han cambiado y son mas fuertes hoy en dia. El comprador goza de mayores protecciones., ya que vendedores y agentes de bienes raices tienen la obligacion de dar a conocer al comprador los problemas, pues de no hacerlo incurren en severas sanciones.

thanks for the comments, :) yes, I agree , the same here in Colorado and I believe that now in most states are strict on this one,  Texas is one of them and I do not know about the other, we should ask Sandra about this   thanks for everything.

Ray, Welcome back..long time no see. The problem with that saying is the grey area with diclosure is hard to determine if all is really being disclosed. Some sellers will not mention things and it seems they might be hiding something. But remember buyers have the right to inspect and rely on the reports they get.

thanks :) hopefully I can be writing , reading and commenting, that's true what you wrote, the buyer has the right to get a deep home inspection and if they see a big problem or something that can not get a resolution then back off. thanks for your comments, soon I will be on your blogs. :)

Lizette, Agree with that, sometimes is not worth fixing or that's why the buyer can back off. :) Keep the good blog / work.

Hi Ray,

In Pennsylvania there is a required Seller Disclosure which must be given to buyers as part of the offer to purchase.  It's 4 to 5 pages long and goes into quite a lot of detail.

I always like when you do your posts bilingually, so I can compare the two and try to learn the Spanish.

Buyer beware is long gone in California - though our paperwork (contracts and disclosure forms) all tell the buyer to take responsibility and investigate throroughly etc.   Here it is more like "seller beware" - if the sellers does NOT tell the buyer something "materially effecting value or desireability" (in CA that means anything, physiscal or structural or not) and the buyer finds out later, the seller could well be likely for damages.... It really is a complete turnabout from the old Caveat Emptor here! 

Interesting how it varies from state to state....

Sometimes, I can not translate the same words, because it does not make sense, sometimes I have to use other words to make a good translation, but you will get the whole enchilada, and that's interesting to know that in your state you have some other disclosures / information, thanks for the input, I always appreciate your comments.
