Temecula Valley Homeowners Facing Foreclosure -- Beware of Foreclosure Relief Scams

When a Temecula Valley homeowner has defaulted on their mortgage—meaning they have missed at least three payments--their servicer will file a Notice of Default with Riverside County, which becomes public record. A homeowner in default of their mortgage often receives numerous solicitations from those claiming to help them in their time of need.

Some red flags that indicate an individual or company may be trying to take advantage of a Temecula Valley homeowner’s situation:

  • Asking for upfront fees to save your home from foreclosure – It is illegal in California for anyone to take advance fees from a homeowner for loan modification services, except for licensed attorneys.
  • Outrageous claims that an individual or company can get the title to your home “free and clear”, or dissolve your mortgage, for a fee, of course.  After the fee is collected, nothing is done, and you are out the money you paid them and lose your home to foreclosure.
  • Mass joinder lawsuits – The individual or company claims you will be added to a class action lawsuit with others against your lender, for a fee, of course. After the fee is collected, nothing will be done, and you won’t hear from the company again. California Department of Real Estate warns about this scam.
  • An investor claiming they can make a deal with your lender to payoff your mortgage so you can stay in your home, for a fee, of course. After the fee is collected, your home goes to foreclosure.
  • Flopping –An individual or company claims they will bargain with your lender for a short sale and then sell or rent back to you. This is considered mortgage fraud, especially if you, the homeowner, must sign an arm’s length affidavit as a condition of your short sale.
  • MERS Debacle -- Claims by an individual or company that because your mortgage is part of the MERS system (80% of all mortgages in the U.S. are part of MERS), and your lender or servicer is illegally and unlawfully foreclosing on your home. There have been several court decisions that uphold MERS

Pamela- Very good warnings. Our Florida State Attorney General is quick to squash as many of these scam operations as possible. They keep creeping up though. 

Never Sign over the DEED to your property to another party without consulting your legal council first. THis is another scam that goes on. The company tells you they will make your mortgage payments for you and work the deal out with your lender. You sign over your deed to them and they keep all your money. They change the address of where to send communication from your bank so you never hear a word again from your lender and assume it all worked out. BEWARE of these people who promise you things like this.

Great post!  We've seen so many similar stories in Florida.  It is so heartbreaking to see so many taken advantage of when they're down & out!  Our Attorney General has quite a few lawsuits pending against these crooks!

Katerina, I heard some news the other day that our State Gov is going to change how the DRE is organized because, you know, California is penniless. If the changes go through (right now just talk) it will be more difficult for consumers to make complaints. 

Thank you for pointing out about never sign over a deed to anyone who promises to pay the mortgage. Homeowners may think this is ok but it's not and causes too many problems later and they will lose their home to foreclosure. 

Joseph, I hope they get all the crooks who do that to homeowners who just don't know.

You should repost this at least once a week, updating it with all the new scams which are popping up. Every week in the C.A.R. NewLine, they have scam watch and at least once a month, I find a new one which is very cunning and if one was not an experienced professional, easy to dupe the public with. It seems no matter how many times you warn them, someone is getting duped. I guess it is all in the numbers.

Curtis, I'll be sure to check out the C.A.R. NewLine. Thanks for the tip. The CA DRE also has posted information for homeowners to prevent from being scammed. The biggest scam last year was the Mass Joinder lawsuit. Sounds very professional and convincing. I received emails on it and studied it. I decided it was a scam because after investigating it (wouldn't that be grand for California homeowners?) they required up front fees starting at $5000. The attorney and the office who master-minded this is in BIG trouble.

There's a new scam floating out there now which I am trying to get to the bottom of. To me, it sounds really hinkey, but to the homeowner who doesn't know, and really wants to hang on to their home, it's like a dream come true. What is it they say about scams? If it sounds too good to be true, then it probably is.
