      We explained our qualifications and sent them information about the areas and about our experience in real estate and suggested that he and his wife discuss who they would like to have represent them in the purchase of their home.

Before I started selling real estate, I once had an agent to tell me not to look at homes while he was on vacation.  Huh?  Sorry, but I did and I bought a house.  Moral of the story, if you are going to be on vacation, please have another agent to cover your customers and/or clients.

Without a Buyer Agency Contract with the first agent, you are certainly free to establish contact and create the relationship yourself. I wounder what they would have done if their agent was not on vacation?

Well put! A lot of buyers don't realize this. I like to sit down with buyers and have a buyer consultation to understand their needs, get them prequalified if needed and show what I will do for them. This has helped a lot. I have found that many buyers don't understand how it works in real estate (and why would they?), we need to educate people and show our value.

Sally and David, your analogy of how we get paid is a good one. The problem I would have with this buyer is they have no loyalty to their agent. How loyal will they be to you.

Sally & David - I've had this happen to me as well.  I take their information and then attempt to make contact with their agent to verify what they've told me.  Then, with their agent's permission, I will show them MY listings only.  No one elses.  After the showings, I tell them that if they saw anything they wished to pursue, they should wait for their agent and then go back through it with them prior to writing up an offer.

I do this because I promised MY client, the seller, that I would make a continuous, good faith effort to find a buyer for their property.  My job is to sell their home.

I had a young couple walk into the office (in Toronto) and tell me they are looking to buy a condo in Downtown Toronto …… had a chat with them   …… they are going to use their parents realtor, who lives in Newmarket  ..... and they are just doing the ‘legwork’ …..

I, as I'm sure you do as well, have a fellow Agent I trust look out after my clients while I am on vacation. This way, the client's needs never miss a step and I can enjoy my vacation know they are being looked after.

someting similar happened to me just this past weekend on one of my listings.  Buyer found it on Realtor.com and asked me to show it to him said he was serious etc.  I re-arranged/pushed back my Buyer appt. for that morning to show this "potential" Buyer my listing.  (1) he was LATE.  (2) he wanted me to take more pictures b/c the 25 on Realtor.com were not enough and his sister wanted to see more (3) i took 50+ pictures for his overseas sister (4) asked me to come back later that day (Superbowl) and I arranged someone in my office to show it to his wife (5) we scheduled to meet the next day at HIS office to sign the offer etc. (6) after all this B.S. he ends up telling me there is an agent that he has used i the past ..... i stopped him there and said you are welcome to use another agent to show you OTHER houses BUT i showed you this one so I or one of my agents in my office will have to represent you NO EXCEPTIONS ~ he said i understand and 2 hours later he called back to say his sister (overseas) didnt want to use me b/c she had that other agent they've used before.  SO THEN WhyThe HECK didnt that "other" agent make time over Superbowl Sunday to show you the home & take 50+ pictures for your sister oveseas ???????? HONESTLY I WISH PEOPLE GOT PAID ON A PRODUCTION BASIS THE WAY WE DO & MAYBE THEN THEY'D HAVE MORE INTEGRITY....

Hi Sally & David, excellent blog on a very important topic.  In Florida, though, procuring cause is the agent who writes the offer.  So we have to be very careful.  And buyer broker agreements can be cancelled by either party by simple notice.  That notice could be delivered at the same time the offer is submitted by the other agent!
