Today I read a story from azcentral.com that made me sick. It is about the woes that come with buying property in Mexico. Unfortunately many Americans have been misled and defrauded in shady deals to buy property in Mexico. The article goes into detail about several investors and buyers who have lost an extraordinary amount of money. It is estimated that over $100,000,000.00 have been swindled away from buyers and investors in these deals to buy property in Rocky Point, Mexico. This is very disheartening for many people who invested their savings.

Worst of all, the United States and the Mexican governments have not come to the buyers and investors aid. In fact, they all seem to be passing the buck. Lawsuits have been filed but nothing has made anything better. Only finger pointing and bickering continue, no actual end is in sight.

Only time will tell what will happen, but one thing is for sure, "Buyer Beware" if you plan to invest in Mexico Real Estate. Do your homework and due diligence before buying property in another country. The laws of our country do not hold any ground in those countries, and you might be in for a lot of heartache if you do not know what could happen to you and your money when investing on foreign property.

I love Mexico and hope to buy there one day, iut distresses me that the purchase of property there may not be the best thing for us.

Puerto Penasco is a great place with a promising future as a resort town.  But I know a fellow who invested there and it turned out to be a real estate nightmare.  Regardless of the differences between our laws on either side of the border, the Mexican government will have to take some proactive steps if they expect to continue to attract real estate investors from the United States.

I was so disturbed after reading the article that you provided. I think that it is a shame. I also believe that buyers should be aware  and do a lot of homework before buying in any foreign country.

Robert:I still think you can buy property in Mexico, you just need to be aware of all the consequences and understand the law in that country. It would be wise to consult with attorneys and do all your homework before you do buy anything.

Bob & Carolin: I could not agree with you any more, BUYER BEWARE.

Eric: Mexico should do something, or I will not advice any of my clients to purchase any property in Mexico until it can make it safe for Americans to buy Real Estate. Otherwise we will put our clients in harms way, and possible fraud.

Yikes, what a mess.  I hadn't heard about this.  Thanks for putting out here.  I ran into an agent last year who is selling property across the way on the Baja.  This definitely requires investigation before handing over the money.

Ouch! Thanks for sharing the article. My wife has been talking about buying a little place in Mexico for some time now. I think we will really need to do our research which of course we should be doing anyways.

I hope that this all is resolved for the best.

Hi Ulises,

We always use a law firm here in San Diego to assist our 1031 exchange clients when buying Mexican real property.  They have an international tax practice where four of the attorneys were educated first in Mexico and then came to the U.S. and obtained their J.D. and then passed the bar here in California and two were edcuated first in the U.S. (including the partner in charge) and then went to Mexico City to obtain the equivalent of our J.D. and their bar.
