Lawsuits, Localism & You

Services for Real Estate Pros

My co-worker, office manger, friend and Real Estate Trainer, Midori Miller recently posted an excellent post on bloggers being sued and how we need to blog responsibly.

In one of the 199 comments the commenter mentions that they post mostly to the consumer in Localism and "that they don't have to worry when the consumer is their target".

I enjoy reading this particular person's posts, they write well, and keep me coming back for more. However, I have to disagree with that statement, let me explain why....

I too post a lot to Localism, and recently I did a post about the Gaslight Parade in Ormond Beach over Thanksgiving Weekend and also that a band that was very well known from the 70s was going to be on Main Street the next night doing a show.

I didn't have my facts straight! For once I didn't research my blog. I told everyone that "we will be going to the Muscle Beach - Hot Rod Show and Shine on Main Street that starts at 7PM and also popping in to see a sound check by the original members of Foghat".

What I didn't know is that is that the original surviving members of Foghat can not tour under the name of Foghat because someone else owns the name Foghat, so they are now touring under the name Tony Steven's Slow Ride. Had I done 2 minutes of research I would have known this.

When I got home, I edited my post title and post to read: The 50th Gaslight Parade & Block Party In Ormond Beach (Edited)

"Tomorrow night we will be going to the Muscle Beach - Hot Rod Show and Shine on Main Street that starts at 7PM and also popping in to see a sound check with the band formally known as *FOGHAT, now known as Tony Steven's SLOW RIDE show at the Banks and Blues."

Then at the bottom of the post I followed up with the asterisk like so: " *The original surviving members from Foghat do not own the name Foghat and are now touring as Tony Steven's Slow Ride. I didn't know this at the time I posted this."

I hope that I covered myself with this and do not get in trouble with the actual band Foghat.

We all need to make sure we know what we are talking about regardless who we are targeting with our posts.

We need to take the time to research our articles, and our events.

We need to make sure everything in every post is correct no matter where that post goes.

I do think Localism posts need to be accurate but I don't think I would get hyper about an honest mistake.

Lysa, I read Midori's post and now yours and I agree that you need to be careful with whatever you write no matter where it is posted.  People from all walks of life are reading our posts and comments and I try to be very careful on anything that has my name to it.  Your posts are wonderful and it was a mistake that you found and corrected.  The band should be thrilled, you are still promoting them.  I love your posts and this one has an excellent point of view.

I too had to change something in one of my posts!  I had stated that all one had to do was get a permit from the Board of Water supply and they could hike in a certain area....  They called me to let me know that they just posted a sign and NO they could not go hiking!  They even called me back later to thank me for changing my post.

YOU NEVER KNOW WHO IS READING your blog!  What people do not get is beyond me. I don't care if it's public or members only. ANYONE can join and read our stuff. All it takes is a few strokes at the keyboard and they are members.

Carole, Thanks for reading both posts! I was the thrilled one to get a private mini concert by Tony Steven's and Company. They are really doing great on the tour scene!

Sally, Was this post about the 99 Steps? I never did hike up those steps but I think my dad did. I did a search recently when my dad sent me an article on the steps and found conflicting reports in a few blogs about whether you can hike them or not.

Is this what you were talking about? There are people who do this for a living and will take the time to prosecute if need be.

Lysa - Thank you for the strong reminder.  It's always a good idea to check on the "correctness" of what you are writing.  Each and every agent knows that there is always someone who could threaten to sue . . .for ANY reason.  It's such a shame. . . and yes, it is scary.  However, if we as individuals just try to do our best . . .then we should not fear the outcome.  Thanks to you . . .we have another gentle reminder.  Have a fabulous week!!

Many times I decide not to post things, just because I am not sure of the accuracy or whether it will cause a problem.  You can never be too careful with some things.
