But the seller can't profit on a Short Sale......

If I hear this one more time I am going to scream!!!!  I have many short sale listings and have had buyers who bought short sale listings over the last 5 years. I feel I can voice my opinion on this matter because I am not just saying "I think this is right" I KNOW this is right! I called the TAR Texas Association Legal Hotline and verified it.

When your buyer makes an offer on a short sale and your buyer does not offer the option money for the termination period in Texas contracts, then the buyer has a valid contract, just not a valid termination option. This means if the buyer opts out the seller, even if he is short selling the home, can keep the earnest money!

Think about it! You are not contract legal if your buyer does not offer consideration for the termination option period, PERIOD!
