My sister Paula, the owner of HomeRun Title, has been in the business since she was 18 years old. I have heard many stories about this business back from 1992. How times have changed over the past 15 years! Just the Title Insurance business itself.

You see, my sister started out with a family operated title company as a "Title Opener". Not knowing anything about the industry, the owner's of the company took her under their wings and taught her a good deal of what she knows today. Needless to say, the owner's retired and they asked Paula to stay with them for another 6 months to handle any calls that came in with any questions relating back to files that closed. She agreed. What she told me the most important thing she learned from this company was "Customer Service". Most people who decide to shut their doors, do just that. They still cared about customer service and that's why they had her stay. This is where my point is starting to come in.

Back in those days, there was no such thing as that now forbidden word...."KICKBACKS". How you got mortgage companies, realtors and lenders to use you was to be "Professional, Knowledgable, Attentive and Curteous". This is what Customer Service is.

Over the years, Paula had received many recommendation letters from companies like FORD and GREAT WESTERN, amongst the mortgage companies. She would herself handle over 200 files a month. One of her main things was, you always take the customers phone call. Even now, we don't have individual voice mail. We are taught to pick up the phone, no matter what.

So you see, when she told me I should get into this business 4 years ago, I was taught the same values. I was originally hired as a Marketing Rep. Prior to entering this business, I was in sales for many years with Howard Johnson Hotels.  To me, I figured it was a no brainer. This was my chance to start a new career and work for my sister.

Coming to my close now. Was I so wrong about a no brainer. When I first started, I had to learn the ropes before I could hit the streets. You have to be able to know what type of service you're providing and be able to answer questions. Once I knew this, I was very excited about going out there and getting business. Much to my surprise, I kept getting people ask me "What KICKBACKS does your company offer?". The first time I heard this, I didn't know what to say. My response was "Let me make a phone call". After speaking to my sister, I told the guy that we don't offer KICKBACKS but our Customer Service is outstanding and just give me 1 deal. I was told "Sorry sweetheart but our title company gives us $300 per file". I thanked him for his time and walked out. Over and over this is what I get. Do you want to know how many companies I acquired as my client in the past year and a half? TWO!

This business has come down to pure greed and that's one of the biggest reasons why this market is where it's at today. GREED!

All I can say, is thank GOD, the buyer gets to chose their title company. That's the reason we're still in business today because of the Customer Service we have given to the customer. They always come back and refer us to their friends. It's just too bad that not everyone knows they are able to use their own. Even when they do, they are for the most part forced by the parties involved to use someone else. Why? Because the company is getting a KICKBACK!

I am not in any way, blaming it all on the brokers or realtor's. If my own Industry would not offer these things, then they wouldn't exist! So do I ever think things would get back to the good ole days? Unfortunately not.

Ah, the good ole days.....  the days before you needed a form to assure your client you would be honest and deal fairly with them.   The days when you were loyal to title companies or lenders not because of a kickback but because they did the best job for your client....and you.

I was first licensed in real estate before FAX machines were standard equipment in every office - Realtors were more interactive with EACH OTHER and not so cut throat and deceptive as today.  Yes of course there were snakes even in the good ole days but it's different today.

There are still a lot of good, honest people who are sincere in the work they do.  I just wish we could get rid of the licensees who use trick & scheme (decption) in their drive for a big fat commission check.

You are here in Florida and I have to admit that I am surprised that kickbacks are so common down there! I have used many title companies, but I do have a favorite and if a customer asks for a recommendation, I always say Sunbelt Title in Port Charlotte. They do offer the best possible kickbacks! Freshly baked cookies! And during the Holidays, their office manager even brings them around to different broker offices for the agents! that is the ONLY kickback we get and I must say, it is the best! It is legal and ethical!

I don't know Barbara-Jo what it is with down here but I can't even stress how bad it is! I'm not in any means conceited but I must say, I'm attractive, smart and one of the most outgoing people you could meet and I can't get past the front door of these places! They have no shame to immediately ask what I'm going to give them. One title company walked into one of the offices of a mortgage company I deal with and besides offering them the money, stated they have a Yacht that they let the brokers use whenever they want. Unbelievable!

Dawn,

Take a look at the Sherman Anti Trust Act and I think you will find the offense of accepting a "kickback" quite expensive to the individual and the firm.  This is unbelievable to me.....no one would ever offer me anything for my business because I have a reputation for doing what is required under law....turning them in.....

I will take a look at the Sherman Anti Trust Act. Thank-you. I will also say, Paula, the owner of HomeRun, has a vacation home in Georgia and has told me it's like a different world there. The realtor's openly except you into their office, they are extremely polite and she never heard a mention of KICKBACK. Now I'm not too sure if everyone is like that but two thumbs up to Georgia!

That practice is definitely illegal in Oregon. It's too bad you have to work in that kind of environment. How can Florida allow this practice? It's not good for clients.

It's not good for the clients. I question all the time how could there be so much of it going on here? Considering it's not really a hush hush thing. People are really open about it. I'm careful about what I say but when the actual client tells me someone was trying to force them to use a particular title company, I let them know usually when that happens they are getting something from it. It's not always the case and that's why I'm careful not to implement anyone.

Hi Dawn, I just found your post by following a link in Lenn Harley's article.  What you have written about kickbacks hows how terrible the practice is.  How can people be so greedy?  I hope that as more and more consumers and agents are made aware of this practice that there will be positive changes.  You are a new agent for positive change with your blogging!

The sad part is that the majority of KICKBACKS are the RESPA LEGAL ABA's.  So many Realtor Owners and Mortgage Brokers float out into the market that they will give their business to the highest bidder.

My company, Bertrum Settlements has thus far refused to partake in this discusting business arrangement.  We are doing quite well without this nonsense and wish the Mortgage and Realty industry would simply try 'harder' to make their profits without sucking 'FREE MONEY' out of the Title industry.

Extortion.  Sucks.

I hear you Rob. ABA's are something that I refuse to deal with. Again, I prefer to get my business the good ole fashioned way. Working hard and proving who and what I am.

I know of a mortgage company who has interest in a title company and in speaking to some of the brokers, they call the company "NO CHOICE TITLE". What I have noticed with all this is these mortgage companies and realtor's at some point in time, wind up having problems with the whole agreement. The title company no longer needs to work hard and give the best service possible. Why should they? They know the title orders are still going to come in everyday because they have the arrangement.

I am amazed at the number of Realtors I've spoken that 'HATE' their Title Company (incompetent, not flexible, etc.), yet CONTINUE to use them.... because they get a piece of the action.  And they say this with a straight face.

Being in this business for 26 years I have seen just about everything you are commenting on. I don't think anything significant will happen until some serious enforcement of the existing laws happens. I mean people need to go to jail. In California Title Companies have paid hundreds of thousands of dollars worth of fines, but to my knowledge no real estate agents or lenders have been fined or even had their hands slapped for accepting kickbacks. I keep doing everthing I can to be an honest operator and will keep doing it. I have made a good living for many years and I hope to continue that as well.

My thoughts exactly Greg. People do ask me why don't I just cave in and do it. Besides it being illegal, I work hard for my money and why should I give some to someone else who is also getting paid. Just like you said, big deal they get fined. The worst I have seen is the underwriter for these title companies won't underwrite them anymore. What do they do? They open up again under a new name and with a new underwriter.

Dawn, it is refreshing to read your post and to see other people who conduct business in an ethical manner.  I spoke with a lady recently who is in medical sales and  many the doctors she visits want to know what they're getting out of it.  How about thinking of what their patients are getting instead?

Keep doing things the right way, in the long run you'll come out ahead.

Thank you Tchaka for the comment. It's amazing but this really doesn't just apply to real estate industry. So many others want the same thing.

I will always stand my ground when it comes to kickbacks. Thanks again.
