I just came across an Atlanta real estate Blog where the real estate Blog's owner must have thought themselves a marketing genius!  I thought they were just rather stupid, and should have done some research before posting their Atlanta real estate Blog!  Perhaps they should have had a little discussion with their broker...before marketing their image so publicly.  Not only is it illegal, and in violation of MLS IDX...it is extremely unethical to other agents, and must leave the public scratching their head!

Here is what the agent did. 

Item 1.The agent was writing Blogs about listings that was not their own.  A major no-no!  In fact a violation of state law.  In essence...they are advertising a listing that is not their own, and could lose their real estate license over it! 

Item 2.  Their Blog isn't Broker reciprocity!  So posting a disclaimer that the listing photo is compliments of the MLS system doesn't cut it!  It constitutes and bootlegged data...that once again...they have no right to market!

Item 3. A vilolation of Georgia state real estate licensure for websites - non disclosure of brokerage, brokerage affiliation, brokerage contact information.  Anonymous marketing!

It would be one thing if a real estate agent wrote an neighborhood real estate article on a subdivision, street, or a city enclave...that would be rather informative, newsworthy, and could be tied together with some sort of marketing  contact information...

There's an agent here that has three blogs ... all filled TOTALLY with plagiarized material! He's stolen articles from other agents, CNNMoney, MSNBC, Business Week etc. Hope he's got deep pockets!

HI  - Newbie here -  good to know how you feel about the advertising of others. In the MLXChange MLS in Broward,  actually the SEF MLXchange - there is a field for OK to advertise. Which the listing agent can check - NO or YES when putting in the listing.  I believe it ok to advertise, and to give credit to the brokerage house having the listing, in the usual 3 point font at the bottom, just like the MLS formatted 'views' of the property do at the bottom. So, I guess I am saying that not all areas work the same.

Jim, Not having seen the blog in question I don't want to comment on it, but in general, brokers need to exercise control over their sales people's blogging. I know a ;ot of bloggers here on AR don't want to hear that but it is the case. And you are righyt, the broker could lose his license if an agent licensed under him is engaging in unlawful activities.

I've started to treat my blog as any other form of markeing so all the stuff is in every post.  I don't want to have to go back at some point and repair it since I know the day is coming.

So can I put in my market reports wording like:  there is a 4 bedroom home active and listed for $799,00.  If you'd lke to know more about it please call me?  (no MLS, no pictures, no address, no info)

Elaine Reese, REALTOR® in central Ohio  Hope their broker has deep pockets!  LOL!  Hope the broker really has a need to have an agent like this on board! (Relative?)  LOL!  Under all state real estate laws that I know of...brokers are responsible to review all marketing, and ads.

Decker,P.A.-Realtor Broward County FL  Check with your broker.  Some MLS used that initially to have a check off for Broker Reciprocity or IDX.  It does not mean you have a right to personally market someone elses listing from another brokerage.  Please check with your broker to explain.  When in doubt, always ask broker.

Josette Skilling ~ Bethesda Maryland Real Estate Sales  You have to comply with what ever state real estate laws you are licensed under.  In Georgia we have to treat a web that sells homes or real estate, as are the same Georgia real estate laws that apply to real estate signage!

Jim - Sorry.. when you check the YES box it says ' I grant other brokers permission to advertise this listing in the media " - I was personally saying that I would give acknowledgement to the listing brokerage house - but nothing in the little message box says that I have to... 

and the INFO box says " The "Ok to Advertise" field means that it is ok for an agent to advertise another agent's listing(s) in a written format."

And Yes there is also an IDX which is locked to YES and another for Internet that has the option of Yes or No, meaning you can add remarks for the Internet upload

So respectfully, when working with agents in other areas, disagreements and raised eye brows can be avoided by understanding how it is done in that location.  I do agree with your underlying message that we have to understand what we put out there. and I am glad you brought up that message.

Decker,P.A.-Realtor Broward County FL  See that varies state to state.  I like that idea, but that is not allowed in Georgia only if it is under the same brokerage/owner.  The law was modified recently to clarify the issue.  Obviously the person writing that Blog did not get the news!  LOL!

Jim, the agent doesn't work for a brick & mortar broker, if you get my drift. They still have to follow the rules, but they probably think they're "under the radar", being that they're small. It's one thing to steal another agent's posts, and quite different when it's the big network$$$$. He's on AR with kersplatts on all his posts, but AR isn't deleting them or him. He also makes a personal claim that is simply untrue.

I think our laws must be similar to yours in GA. Non-licensees aren't allowed to advertise property for sale. We're not allowed to advertise other's listings unless we have written permission and the listing agent/broker is identified (reciprocity). We can advertise other agent's listings within our own broker, however. And our Board forbids using property photos that were taken by others. All these are subject to fines by either the local board or the State Commission.

Here on AR, there is a Florida lender who has advertised an Ohio property (in the OH section of Localism), used the Ohio listing agent's photos and write-up from the Ohio agent's web site, and without the agent's permission. So he's violated several Ohio laws. I suppose he's doing this to try to get business from Buckeyes moving to Florida. Rainers need to check state laws before they venture outside their own state, because not everybody has the same rules.

Elaine Reese, REALTOR® in central Ohio  Thanks Elaine!  Great story!  There used to be a comic strip years ago that was called..."There Ought to Be a Law!"  LOL!  Well there are, but I guess that does not stop some people! 

There was an agent here in Atlanta that was prosecuted from another state a few years ago!  He was advertising listings for sale that were from another state where he wasn't licensed!  I assume he thought he was creating his own www.Realtor.Com   In Georgia I cannot go ourside my immediate brokerage and advertise another agents listings, with their photos, and without asking permission!!!!  That is like I am in REMAX, and I take it upon myself to advertise Coldwell Banker, or Prudential's listings without telling them!  That isn't creative, it's criminal!

It amazes me, how many people-both agents, and non-agents, think that we're trying to hold onto our "precious information" by using our MLS systems. I've even heard agents say  the MLS is being replaced by the internet. But they're forgetting that we have a responsibility to our sellers to present their properties in the best light, in order to sell it. The seller may not like what other agents are doing with their listing info. That seller chose a particular agent for a reason. (Too many possible reasons to list). 

And then there's the possibility of a law suit, to the agent and/or brokerage who spreads incorrect information about a listing, to the public. There has got to be some form of quality control.

Wow! There are so many ways to "sneak" and so many ways to get caught! Brokers pay far less attention than should be and is required by law. I mean really, how many brokers are really looking at blogs or even at agent websites??!

Jim, interesting post.  I often see postings either advertising a listing not their own--or even "bashing" a listing not their own (e.g., this is a terrible picture, this house is an example of being overpriced, etc.) and scratch my head wondering about it.  I think most agents (though obviously not the one you mention) realize that they can't advertise, but I wonder whether agents realize that by commenting (negatively) or pasting pictures of another's listing they are also potentially opening themselves up to a heap of problems.
