   Working for a property management company here in the Antelope Valley, I get several calls from people who have doomed their rental property by making the same tragic mistake.  Generally, they will call me asking about our fees and services.  After answering several questions about how we screen tenants and how much we can rent their home for, they drop the bomb...

"If I sign up with you, can you evict my tenant who is not paying the rent?"

   AAAaahhhhh!!!  It is an unfortunate fact that human beings are often taken advantage of.  One reason being that we generally WANT to trust our fellow man.  Equally unfortunate is the fact that there are so many people out there who would LOVE to exploit that trust!  Almost every time, the desperate caller on the other end of the phone has committed the carnal sin of the rental market.  The one tragic mistake that causes more heartache and trouble than any other mistake possibly could.

    They let someone rent their home based solely on a handshake.  Often times, they will say something like, "the guy seemed really nice, but now he hasn't paid his rent in three  months."  Someone can seem like the most awesome guy in the world.  They can be charming, articulate, charismatic...and a liar!  While you are shaking one hand, the other hand is prepping the dagger!  Unfortunately, many people who choose to manage their homes themselves fall victim to this type of trap.  In fact, several people have come to us with a non paying tenant who never even signed a lease of any kind!  People are out there actively trying to find oblivious owners to prey on.  That is why it is so critical to find out everything you can about someone BEFORE you turn over possession of your home.  As a company, we have found that screening applicants intensely can pay off in huge dividends!

   If someone tells me that they make $200,000 per year, I tell them, "That's awesome!  So you should have no problem when we verify employment, pull your credit, and check your rental history!"  Honestly, I don't care how much money you make.  You could be making $200,000 per year and STILL not pay your bills!  Not long ago, I ran the credit of someone who made a NICE living.  Unfortunately, his credit report showed that he liked the cool toys but he suffered from an aversion to PAYING for those toys.  That is why it is important to verify everything that an applicant says. 

Don't take their word at face value.  Behind that face could lurk a mind with no values.

Part of the real estate company I work for is a property management company also. I see the horrors they deal with over there (people and problems).  I wouldn't want that job for anything...to have to go into a home that the previously evicted tenants pooped and peed all over the carpet and left dishes and food out everywhere and wrote on the walls with marker...No way, no thanks...

Amy - Wow that is gross.  That is however a good example of why tenants need to be screened thoroughly!  There is always going to be a risk in renting out your home.  Anyone who says they can eliminate risk is a liar!  All we can do is minimize it!

Great advice. I purchased a distressed property and inherited a couple of dead beats. I wanted to be nice and realized the people in the home were not like me. Then I got tough.

I hired and attroney and went to court. The tenant suddenly did not speak English and needed representation. She received a socuial worker, a housing specialist and a publuc defender. I heard all this in court and busted out laughing. (this I don't recommend).

Anyway I got the tenant evicted and then rented to much better folks. IT was a pain, but it was not a fatal lesson.

Yeah, we get this a lot. Probably half of the evictions we've done over the years have been of tenants who were already in the property when we took over management. The worst case was a situation where the kids were scaring the neighbors by hacking at the trees with a hatchet, and when they left there were knife holes in the front door. That one cost the Owner about $4000 to fix.
In AZ, even if there is no written lease, the AZ Landlord and Tenant Act still applies, so we just start the appropriate paperwork. It takes about a month to get a tenant out.

Leslie - Wow!  You got some crazy ones huh?  I haven't had to deal with knife weilding, hatchet crazed kids yet, but who knows?  It may happen!

Jonathan, great words of caution.  I cannot imagine adding that to an already challenging task.  People that won't get out- talk about the owner being held hostage.  With many homeowners considering renting their properties (great for your business!) this could become another "issue."

Laurie - I think it will.  A lot of people don't want to pay a management company because they think it will be easy to handle everything.  Unfortunately, that sometimes causes them to miss the steps they should have taken in the beginning!

I guess I've been fortunate. In 1980 I rented an apartment to what looked to me like a good guy holding a baby in his arms and family. Well when he moved out in 2001 that baby had just graduated from college. They were the best tenants I ever had.

I love this BLOG!   Mom and Pop landlords seem always to manage to get in the best jam's possible.   I normally refer them to a good lawyer!   It's interesting that unqualified tenants who get a cold-shoulder in our office often end up renting from a Mom and Pop outfit.  I guess it doesn't matter that Mom and Pop charge less than market price for their unit because they probably won't get any rent anyway.   Jerry

Excellent post! I feel strongly about property management for that same reason. I feel as people like you and I and all of the other (serious) property managers out there continue to expose the foolishness we will begin to restore respect to our designation as Property Managers.
