One of the forms you will be asked to sign if you are considering buying or selling a home is the Agency Disclosure.  The form is required by law in the state of Nebraska.  The purpose of this form is to inform the client or customer the nature of the relationship of the licensee in the transaction.

As a consumer, it very important to know who is looking out for your best interests.  The form is NOT A CONTRACT but it informs the consumer of how they are being represented. This form should be given to you at the earliest practicable opportunity.  You should receive a copy of the form and the agent will retain a copy for their records.

We have a similar set of forms here in Florida.  After 7/1/08 these forms will not be required to be signed by customers any more.  That is good for us because it is less paperwork.  Also last month a judge ruled that by having a customer sign this state mandated form that it implies certain fiduciary responsiblities onto us brokers - even though the law was never intended to require those duties.  (A broker is now required to pay some 1 million + in damages all because of this dumb form.)  Crazy judge.  At least 7 months from now the form finally dies.
