One of the documents used in selling a home is the Seller's Property Condition Disclosure.

Seller is obligated under law to disclose to buyers defects in the property known to seller that materially and adversely affect the value of the property that cannot be discovered by a reasonable inspection by an ordinary prudent buyer. This disclosure form is designed to assist seller in complying with these disclosure requirements. Please thoroughly disclose your actual knowledge regarding the condition of the property.

Sellers should take the property disclosure very serious.  If they don't it could take them to court.

The Sellers Property Disclosure is so helpful to the Agents as well.  I just hope Sellers realize how important this form is.

Sellers need to consider the number of bedrooms that their property is "permitted" for when they fill out the property disclosure. In the Tennessee Resiential Property Disclosure form, there is a line (#25) that reads, "If septic tank or other private disposal system is marked under Item A, does it have adequate capacity and approved design to comply with present state and local requirements for the actual land area and number of bedrooms and facilities existing at the residence?"  I have found that many sellers are unaware of how many bedrooms they are actually permitted for and simply check "Yes."

I think seller's shoudl fill out disclosures truthfully and to the best of their abilty. What if it were code when it was built and then code changed? Then what is the seller's liability. Can we expect property owners to know this, then if they don't thre should be a Yes, No, Don't know box.
