How does the Lease Option lease-to-own system work?
"Lease-option" describes the process whereby you are promising to buy a particular piece of property within certain time-frame, generally at a price determined beforehand. The process for determining the future price agreed to between the buyer and seller will be implemented at some future date. An example is where a future price will be determined by an independent licensed real estate appraiser, paid for by either party or jointly, before the expiration of the lease period.
Earnest Money deposit
"What does it cost to get into a home under a lease-to-own program? Under either program there is an initial payment of money to the seller ("earnest money" or, under a lease option, "option consideration" or "option fee" ), usually is an amount greater than the normal security deposit when you rent and may be in lieu of a security deposit. The deposit or option fee is negotiable and is usually 2%-3% of the sales price,
When considering lease with option, please keep in mind that any deposit, earnest money deposit or option fee you deliver with a fully executed agreement from both parties will not be refundable if you don't exercise the option to buy - remember, you're buying the right to buy the house. It is considered part of the down payment if you buy and close on the property. Earnest money under a lease-option will not be refundable if you fail to qualify for financing or are otherwise not able to buy the home during the course of the lease.
Earnest money is also considered to be part of the down payment that may be required by the seller or lender at closing. SECTION 8 TENANTS
We have successfully represented Section 8 tenants with vouchers with properties ready to be approved by Section 8 Inspectors. In order for me to assist you, it is important me to know that you have the voucher with you. We will require to see it before setting up an appointment at my office, I would also need to know the number of bedrooms you are allowed and whether you are allowed to rent in Los Angeles City or Los Angeles County, talk to your counselor and determine the area you are allowed to deal with.
A pre-screened lease application, credit report, fico score and proof of income and copy of your voucher will be required prior to showing properties for Section 8 tenants. If you have your voucher and I have the property. all it takes is 2-3 weeks for the home inspector to approve the lease and your voucher.
Before we submit your completed section 8 voucher with landlord information, we will request the full deposit in advance, if the house does not pass inspection, we will return your full depsoit. Most of the times, the inspection does not pass for a minor repair to be done, a second inspection can be scheduled and agreed between Tenant and Landlord and I am available to coordinate it.
We will also prepare the lease agreement in my office and request from you all necessary information and the deposit I just explained plus $30 processing fee to obtain your credit report to make sure there are no evictions in your record, low fico scores may be considered with an explanation, I will also request proof of income since Section 8 Program only pays a share and not the full amount of the lease.
We will make sure the application is returned to Section 8 Rep within 24-48 hours requesting an appointment for property inspection, it usually takes 2-3 weeks for the inspection appointment, either Landlord or tenant must be present at the property for that day. After the inspection is approved and I get a call from Section 8 representative usually within 24-48 hours, they will approve the amount of rent that Section will pay the owner and will inform Landlord the amount of the tenant share.
