Hi Scott, many are in desparate situations and truly don't understand what it take to sell a home. They probably got some bad advice from a family member. I thought about saying a week but if it is listed you could be considered interfering with the listing. Keep that in mind buddy.
What no one has mentioned, is that with an open listing, the property does not go on the MLS.
Placing a property on the MLS is offering cooperation and compensation. With an open listing, there is not offer of cooperation or compensation. Important factors to consider when considering to take on an open listing.
One of the great things about ActiveRain is reading the different perspectives. My approach would have been to "try" to explain that when they select you (or any of the other agents), it is effective a unilateral offer of cooperation and compensation to ALL the other Realtors in your MLS. Raymond Denton in post #47 had a unique twist - use that listing as a segway to picking up buyers and be happy with that.
This sounds more like a courtship than a marriage. When you are testing the waters, there are no commitments. However, when you are married you are expected to become a committed to only one other!
If someone asks me about an open listing, I hope I will just say no.

On another note, your comments to the sellers can be used when an agent finds out that a buyer has other agents helping them.

First, an Open Listing actually can result in less marketing as some have pointed out (MLS, signage, etc.). Second, it can create a sub-agency problem. Third, it's a stupid idea. Fourth, HGTV has ruined the real estate business.

Scott: Good for you to explain to the seller the disadvantages to all parties when involved in an Open Listing. I have never been a party to that in my 33+ years as a Realtor, and I never will be. I have no interest in "collecting listings" versus Exclusive Listings. I provide outstanding service to my sellers by giving them 100% in every aspect of our relationship together.

Hi Scott, I am surprised they even teach about open listings. Maybe it applies in commercial or other areas but not in residential. I have been asked ~2x in 6 years and always my answer is NO!
I've never seen THAT method on HGTV, and I watch a fair amount of it. TERRIBLE idea, tho!!
Scott, Good post. In my area only an exclusive linting can be entered into the MLS.
Scott... same thing here in the Fort Worth market area MLS. IF we tried to enter an open listing into the MLS... they'd hang us by our thumbs. Also... it would be, or SHOULD be totally embarrassing for an agent who would do that.
I have never taken an open listing, and also, to be fair, have never been asked to. I would have passed, too. I get buyer agreements and seller agreements. Interesting situation to walk in on I bet!
Open listings not allowed here either but I would not consider taking one if they were! I like Allen's (#23) response...
Heck NO! An open listing is NOT part of my business model.
I would not have taken it. Sounds like a lot of work and no reward. Plus there are lots of things agents that actively work the listing could do at cross purposes.
you did right, no need of to go spend on open listings... and guess what, when you drive by the property, the sign on it is the owners LOL
Which agent gets to list the property in the MLS, which gets to make up flyers....etc! Strange indeed!
Anything that's not listed on the MLS is VERY bad idea. No, I would definitely not consider an open listing. It sounds a lot like an open marriage, which I'm pretty sure never works out real well for either spouse.
