Today is a sad day for many people in Riverside County, and across the United States.  It is the Holidays, a time for goodwill, peace, and everything else that is supposed to be good in the world.  But for the people that lose their homes it is anything but a happy time.  And what about the pets, the kids, the families that can no longer afford to pay their bills, or their mortgages. There are different reasons people are losing their homes, and people handle foreclosure in different ways. 

Two days ago I received a call from a Lender who asked if I did REO Homes?  Apparently they had just gotten the house back, and wanted a local REALTOR® to list the property. They informed me the people had moved out in the middle of the night. I agreed to go check it out for them, and let them know the condition and value.

I drove to the address which is fairly close to my Office, but when I got to the neighborhood my heart broke. This is an established neighborhood, and used to be one of the best ones in town.  I could see the changes.  For one the street sign was gone, and for another right there on the corner was the house I was looking for, with trash in the front and side yards....visible to all.  Yes, this was the right house, the court papers were taped to the front door, and trash was piled up under it.

I got my camera, and started walking towards the side of the house.  As I got nearer the rear fence a very angry sounding dog protested my intrusion onto the property.  This surprised me, as the house was supposed to be vacant, but I took a quick peak through the window, and it appeared vacated. I wasn't sure if the dog could get into the house or not, but I wasn't taking any chances.

I went back to the Office to call Animal Control, and I also contacted a friend that does clean-outs. At this point I did not want to go through the house by myself, as it was apparent that the  owners had left in a hurry; not even taking their pet (s) with them. Safety is always a concern when dealing with desperate people loosing their homes, and I didn't know the circumstances of their departure.

Anyway, we went back to the house, and shortly afterwards Animal Control showed up.  There were 2 dogs abandoned, and one of them had recently had puppies. 

I felt bad for the dogs, why didn't the people take them with them?  Did they plan on coming back?  Didn't they know that once they abandoned the property that the Bank would secure it, and they could no longer get back in legally?

 

 

 

After Animal Control left, with the dogs, we walked through the property. I can't even describe my emotions.  The misery of losing their home was evident everywhere.  It was obvious this wasn't a planned move, the kind they probably had when they bought the house. They had left in a hurry, taking with them what they could, I guess, and leaving the rest as it was....exactly as it was. Papers, clothing, games, food and trash, the discarded reminants of a Family.Losing your home

Some good people are losing their homes, and some people just don't care. I have seen people that are involved in Drugs, and can't think of consequences, and others that got in trouble when finances changed to the point where they can no longer afford their home.

This REO House was a Home once. What happened?  On the fireplace was a recent Christmas picture of one of the children, and a large Christmas Ornament was lying on the floor, abandoned, along with the wishes and dreams of this family. People don't buy Homes just to lose them.

This picture shows how this Family left.....broken dreams, not caring, just wanting to get out.  They took some things, and left many others.  Who were these people, and how could they leave such a mess.

 

As REALTORS®  we see the best of people, and we see the worst.  These are tough times for many, and I don't know about you, but I am not here to judge anyone.  Yes, I might not like their behavior, or the mess that some people leave for others to clean up, but I don't know the family.  I don't know the mental anguish, maybe anger at a lack of resources that some people feel when they lose their homes.

I will have someone change the locks, and clean-up the mess. I will do my job  to get the house ready to go back on the Market, that is all any of us can do.  But I will not Judge this Family.....they live in my town. I don't know their circumstances. 

I just know that they lost their Home.......They lost the one place where a child had put his picture on the Fireplace, and was waiting for the Magic of the Holidays, and the Christmas Ornament that will be thrown away, tossed on the floor of the house they no longer own.

 Yes, I will do my job......... but I cannot put a Value on a Home,  just the House.

Kathy, I have to wonder where they went and if they couldn't find a place for their dogs.  It is terribly sad to see the house which used to be a home but abandoning the dogs is even sadder.  I feel very sorry for these people, it sounds like they used to have a life and maybe a nice one at that.....

Ryan- I am glad you're the first to comment....it is a sad story.....I could have written it so many way, but today I am not in the mood to take advantage of other people's misery.  Today the social Worker side of me sees a family without a home......with a little kids picture in a handmade Christmas Frame.  And today I am doing my Real Estate job by sending the pictures to the Lender........sometimes Real Estate isn't very much fun.

Carole- Yes, it makes you stop and wonder sometimes....in our jobs we mostly deal with Happy People trying to find a Home....but when someone loses theirs, it's not so happy anymore.  I hope the dogs can be adopted....they're under a year old from what the Animal control guy says.

We are always thing about the sad days of loosing the home and foreclosures. Then I hear my husband talk about those who have this month lost their job because of the housing market. It is an ouch every where for the holidays and not fun.

Susan- You are so right....it is an ouch for many, and it is sad.

Colleen- I remember when I worked for a shelter for abused and neglected kids.....one of the things I learned was you could change the names, but so many of the circumstances were similar, or the same. No matter what the story of todays homeowners that lose their homes, they have in common that common thread of loss........we're hoping someone will adopt the dogs, or that the owners will go to the shelter and re-claim them.  It never hurts to hope :)

Missy-It is a proven statistic that many people are depressed during the Holidays, and what could be worse than loosing your Home.  I pray that they, and everyone in similar situations, find the strength to move forward.

Roberta- Yes, not knowing the circumstances gives you strength not to judge, especially when the dogs were involved.

Lola- There are so many foreclosures.....sometimes the tenants are displaced, sometimes the owners.  No matter who lost their home, it is not easy for anyone, and you're right it is becoming very common today. And all these people need somewhere else to live.....maybe tenants can buy, but where do you the previous owners rent when they lose the home???

I just got a contract on an REO I have..thankfully it was already cleaned out when I took it over from another agent they let go....people sometimes leave in the middle of the night. There is embarrassment when you lose your home but also people have to take some sort of responsibility as well for getting in that mess. It's not an easy thing to happen. Many end up in homeless shelters. I never look at a home on the emotions because we really do not always know what the real story is so I prefer not to jump to conclusions. It is very sad to see those photos.

My heart goes out to these people but they certainly did not handle it very well.  As adults we make decisions, some good..some bad but no matter we must take on the responsibility of our decisions as difficult as that may be.  Easier said than done for sure.

Kathy,  It's sad no matter how you look at it!  There is nothing positive that can be sad for the situation or the people that have lived through it.  Like you said, we see the best and the worst.  Unfortunately, this comes with the territory.  Thank goodness the dogs were all right.  That is just too sad and unfair to them.  They didn't do anything wrong.  They obviously left in a rush, but how long would it have taken to take them to a shelter.

Regardless of the reason, foreclosure is a sad situation for anyone to experience. And at times, we cannot help but to express some form of emotions in the process of doing our job. Afterall, we are human.

Neal-Yes, embarrasement is one of the many things that happen. No matter what happens to them, they will have consequences....try getting a loan later when things have improved, or try explaining to the children where their dog is, or that paper you had to have that got left inadvertently.......  And people do judge, so that comes into play with the neighbors as well.  You're lucky your REO was cleaned out :)

Cynthia- I loved how you said "they have to take some responsibility for their decisions"  oh this is a hard one, sometimes the consequences are more severe than we ever thought......but you're right. Good or bad, the consequences are ours.

Marc- These particular people did leave in a rush. Sometimes people think they can handle the Bank, or that they can borrow the money, only to find out they exhausted all resources, and the end is here.......NOW, so they leave.  That is when some people leave like this.....but the pets, that part is hard to understand.

Derrick- Yes, we are all human.....and we are happy when our clients dreams are met, so it's not uncommon to be heartbroken when we experience the flip side of our job.

Tom- I don't look forward to this....but I have actually seen much worse, and have gotten it sold :)  It's a new day, and hopefully this family, and all families that lost their homes have found somewhere else, and are not homeless.  That to me, would be the saddest part of all.

Julie- One thing I like about Real Estate is the variety.....after this, I got a call from someone looking to buy, a nice couple.  So, as in life it evened out...one sad and one happy :)

Rey- I don't like it either, but it is a reality of our "job". My heart does break many times over the situation so many people are in today........and except for some people that just don't care, many people are loosing their homes.  The Bail-Outs won't help everyone, or maybe not even the majority. From your Lending vantage it must be sad to see how people that used to have good credit are now not even qualified to rent :(

This is such a great point to make, Kathy, and one that keeps coming up for me as well, dealing in foreclosure properties--it's not just those in the medical profession who have to disconnect themselves a bit from the realities of the situation.  Helping people with their real estate more often than not means guiding them through some of the toughest and most heart-breaking situations possible, and you deserve a lot of credit for giving that some attention.

Sister Kate, When I read this post for the first time I had no time to comment.  I knew I'd be here a while.  I am making some time today. 

It is a sad fact of life that many families are facing.  What kind of low has this family sunk to that they would leave their dogs behind?  What did their faces look like when they moved in and how did they look on their way out?  Did the children cry at the loss of their home and dogs? 

When you see the looks on the faces of people losing their homes it's as if you can see through a crck in their soul.  Through that crack you can see regret and despair.  It is too painful to look any deeper. 

Thanks for sharing this.  We as an industry can rewrite these stories with persistence, cooperation and hard work.  We HAVE TO! Or the fabric of our lives will be torn to the point where no one can mend it.

Toni-I swear I answered this earlier....either my computer is possessed or I have some more gray hairs.....in any respect, I did read it, and like how you see right into the tragedy's......as you said though, if you look any deeper it can be painful.  That is true for many of us, there is only so much we can do, look at, or handle.......

If we had to deal with only the sad parts of Real Estate then I wouldn't want to do this anymore.....but we also get to help people by giving them good info, maybe buy that house they wanted, or sell something and need a good referral in their new state.  Whatever it is, I am glad that we don't only work with people that are losing their homes, that is like my old jobs.....too emotionally draining and depressing day in and day out.

Ella- I read your story.....and it makes me sick to see people taken advantage of.  There has to be some sort of recourse against Fraud.... I helped a man write out his complaint and send it to the Reator Board for code of ethics violations, and the lender got his license suspended forr a year,......there are some recourses if you have PROOF.....now to the Foreclosure.....have you consulted a lawyer, or anyone that can help you save your Fathers Home if that is what you want to do? 

It is a shame how some people take advantage of others, and do not care about anything but the dollar they made.  I think we all know some of these people, but thankfully it isn't the majority.......

Well I am about to lose everything, lost my job at the beginning of december,have put out lots of resumes done odd jobs here and there but with the price of fuel it has gotten so I cant even go out any more .I have 52 dollars left to my name from a 50K annual income. I am 47  and have worked since I was 11 to put clothes on my back and food , I have two daughters 12 and 20 both wonderful children. what do you tell them, where are you suposed to go, I write this because I am ashamed and scared, I dont have anymore answers to the questions that run through my head, I feel that I am at a dead end yet I struggle to keep my chin up and not let this emense darkness engulf me and my family,this I just cannot let happen but I just am out of answers.  It is so sad to see this happening everywhere in this country , and there is such a division of people that those who have just turn their heads as though nothing is wrong. we are in a very troubling time we are. may we all find strength. God help us all.

Steve-While I was reading this I was thinking of something I read today.  Someone had lost their job of 20 years, and during the same week  his son had a major medical emergency.  This gentleman felt many of the same things you mentioned...overwhelmed, and at a loss of what to do now.

But today....he stated that he found another job, and his son will be OK....but at the time....he was out of answers.  At the time he felt at a complete loss......and at the time, so many people told him not to give up, and to trust that things would work out.  That is so much harder to accept than to say....but later he reported that it helped him.

I know that when we are in trouble that one of the hardest things is to see Alternatives.....I wish I had answers, but I don't.....you are right, it is a very hard time for many right now.  The normal thing for me to ask is did you talk to your Lender?  I know though that if you don't have any income they might suggest giving them your deed in lieu of the Mortgage.....meaning you sign off the house, and owe nothing, but you get nothing either.  If you own your home.....try to work something out before you are 3 months behind.....sometimes we get so embarrassed that we don't take care of things in a timely manner, and this can actually make things worse.

I hope it works out for you......I really hate how so many people are in this situation.

So very very sad. Feeling there is no hope & you have to leave your home is bad enough but having to abandon a part of your family, too...

Ella, I hope that the guidance Kathy was able to give you are able to get some satisfaction for your father.

Steve, the feeling of hopelessness can be overwhelming, I know. Sometimes just getting through the day is all a person can do. Good luck!

Ella- That is a great question...I will answer the best I can......years ago, Real Estate was seen in the same light as a Used Car Salesman (not all)....and many people took advantage of people (Agents and Sellers, not all).  In order to help protect the Public.....more laws were made that things had to be disclosed....like problems with a house, if the Agent is related to the Seller, or has an Interest in the Property...etc. (these are CA Laws).....Laws were made so that everyone involved had some type of responsibility in a transaction......

They used to say Buyer Beware....and supposedly all the laws, and licensing rules were supposed to help.  I know it has done a lot to protect the Public, but every State is different, and as you know not all Agents adhere to the rules.......if an Agent is a REALTOR (R) then the Public has recourse to report them for certain violations   (In the code of ethics)  or they can be reported to the licensing authority...differs by State. Today it is not Buyer Beware ( at least in CA)...it is Disclose, Disclose, Disclose.

This is a short explanation, but I hope it answered your question.....

My father is being told that the Mortgage Company had the right to increase his monthly non taxable income by 25% and also they did not include my father's monthly auto insurance payment which was also indicated on the bank statements. Just so they could qualify him for a loan they knew he could not afford. They did all this without my father's knowledge. As soon as they all received their money they sold the loan to CitiMortgage, and hung my father out to dry. After going through this mess with my father I can totally understand why there is a mortgage crisis.

Hi Kathy,

We have no idea what we are going to do, we have three dogs and five indoor cats and they are all part of our family.

We peacefully picket six days a week and will continue even after the house is auctioned which is in about 27 days. They sent out three Tucson Police yesterday to have us arrested, however the officers told them we were legal under the first amendment, this has happen many times.

We just keep hoping and praying that a miracle will happen!

Ella- I know from our conversation that you have been trying to find someone to assist you.  By your above comment the house goes for auction in about a month......and you are picketing 6 days a week.  I know this might sound harsh, and I do not mean it to, but someone has got to think of what you are going to do after the house is gone........if that miracle doesn't happen.

Do you think you want to stay in Arizona or come back to CA if it doesn't work out?  I can't tell you to look at all your options......but I want to :)  At least strat looking before time runs out......because then it is too late.

Ella-I thought I had answered this....maybe it was just in my mind :)  I know many people have o idea what they are going to do.  One day at a time.......I know this is the way to go for many things, but it makes me crazy not being able to see past that......that's just my personality.  Ella, I know you are praying, but your dad is 81.....getting thrown out on the streets with all your stuff, cats, and dogs with no plan won't help anyone, nor hurt the Real Estate Company you are picketing. 

 There's an old saying that my mom used to tell me when I would try to stand up for right against wrong: " Don't cut off your nose to spite your face."  It's a funny saying now, but I think the message is the same.....sometimes even when we're right, it doesn't help us any to prove it.............

Kathy, I know you are only trying to help. After paying the bills, buying food and gasoline there is not even enough money to make the mortgage payment. So the only thing that makes sense is to have faith.

Hi Kathy,

KGUN9 ON YOUR SIDE did a story about my father on the 6:00 news this evening, we are so grateful to get the word out to warn other people about Long Realty Company. Miracles do happen!

Ella- Having the news station do a story should definitely help " get the word out".....the auction is in 2 days isn't it?  Hey, I wish I had that station....would have loved to see it, and bet the Real Estate company hated to see it :)

Hi Kathy,

You would not believe all the people that stop us and want to know more, even at Rincon market.

What we did not expect was hearing from people that once worked for Long Realty, some horrible things that were done even to their own agent's.

Kathy,

My dad went to the city council this evening, where they have call to the audience. Every Tuesday at 5:30pm you get three minute to discuss your concerns with the Mayor and Council Member's. My dad said when he had finish talking, he had a few people that were interested and wanted to know more.

The house is being auctioned tomorrow at 11:30. I am not sure why we are going to the auction, I guess we just feel like we need to be there.

Hi Kathy,

I read the comments to my father on these blogs. He said your comments are refreshing, sometimes a few kind words can make ones day.

In regards to the City Council, after my father's three minutes were up, Mr. Rankin the City Attorney along with Mr. Sagara from the Tucson Citizen came up to my father and talked with him.

Mr. Sagara was also at the auction along with his photographer.

They had the auction outside of the court house yesterday, she said they would take $106,000.00 however no one was interested.

Mr. Leal from the City Council called this morning with a name of an Attorney that was interested in what has happen to my father.

Ella- You are right Miracles can and do happen. So, what happens now that no one was interested in the bid?  Do you get to stay in the house till another auction?  This has been a long journey for your father..well, for all of you really.

Kathy,

Yesterday an attorney called, I talked to him briefly and he thought that the house would not go back to auction. Without seeing our documents he thinks that CitiMortgage will take the house back, and our time here will be very short.

He will be reviewing all the documents sometime next week, so we will know more at the end of the week.

Ella- I read the story, thanks for the link.  I also saw you had several comments, some nicer than others....I think that was with the Video, but I can't remember right now.  Just take everything with a grain of salt, and remember when you put your personal business out for all to see, you also run the risk of getting some judgemental comments back.  Hang in there!!!!

The things people are saying about my father and I, does not surprise us given the fact that many of them are Long agent's and Long agent's posing as just public opinion, and of course Joe Neal from Pinnacle Mortgage/First Magnus their now bankrupted partnering company.

What is very upsetting is that the Arizona Daily Star was not able to print the much needed information for people to fully understand what has happened.

There were also many things that weren't true and to list a few... like Pam Treece paying for the service call and getting the heater fixed. My father paid for the service call and we have the invoice to prove it.

There was also much talk about the home inspection. My father told Pam Treece that he wanted to get a home inspection. She said that there was a prior home inspection and he should use it and save $ 250.00.

These people are ruthless and arrogant, this article below was written by a Long Agent up in the Foothills.

Long Realty (the company I work for ) just released the Market Share figures for the six largest real estate companies providing residential
real estate services in the greater Tucson area.
See the chart below.
This is based on residential property sales for all of 2007.
Long comes in at about 3 times more market share than it's next closest competitor, (Data obtained on 1/17/08 from Tucson MLS for all closed residential volume between 01/01/07 - 12/31/07 rounded to the nearest tenth of one percent and is deemed to be correct)
Unfortunately at this point, the graphs have only been released in a print version that does not display clearly on the web. But in both charts(the first is for all residential properties, the 2nd for those priced at $1.0mil+) Long Realty is the yellow band towering over the others.

Ella- I assumed some of the comments weren't from the general public.  As far as News Articles. we deal every day with stories that are slanted, or don't have all the info that we want in there.  Anyway, now it's about getting your father, and you into some type of Housing. There are current decisions that you guys need to be making, and try the Social Services in the area, and also the VA for your father.....maybe they have some resources.

Ella- Hi.....I thought I had answered you here about the home inspections....no they don't expire, however I would keep in mind how old they are as things might and could change with time.  Also, I just deleted the 2 things you posted today, only because they are basically a cut and paste from other sites and/or sources.  Feel free to leave a link if you want......but they were just way too long for my blog.  Hope you understand.
