Good Friday!

There’s a conversation on-going that continues to build steam.

As the Real Estate market starts showing sign of recovery, REALTORS and Home Buyers are increasingly frustrated by the processes around purchasing Foreclosure and Short Sale properties.

Buyer gets excited about a house only to learn that there are bid deadlines weeks away and that there will definitely be multiple Buyer offers for many of these properties . . . This presents uncertainty in a process that’s already rather daunting to the average Buyer.

Often, this results in inaction . . . The Buyers FREEZE in their tracks and do nothing . . . Frustration and confusion is abundant.

The Banks are no less frustrated and confused themselves. Everyone is still looking for that magic bullet that’ll solve the enigma.

The banking industry is looking for ways to deal with a large inventory of Bank-Owned (REO) properties and a sizable back-log of foreclosures in-process.

The truth is – a house stays in better condition when inhabited . . . vacant houses become dilapidated quickly as Nature takes over, humidity fosters the growth of mold in places it wouldn’t usually grow . . . and humans (vandals) do myriad acts of thievery and destruction.

Banks know these things . . . Yet they also know that the sheer number of houses in their inventories is such that if they were to release them ALL onto the market at once, it would decrease VALUES precipitously . . . Decreasing “Real Property Values” would exacerbate the problem.

Some banks want to rent their REO properties to get them inhabited and to create some income flow. The problem is that they are BANKS (not property Management – Real Estate Firms) . . . They’re not set up to do this . . . AND the Real Estate industry isn’t keen to the idea because it sets the Banks up to compete with REALTORS . . . That’s crossing a sacred line.

What can WE do to help?

My instinct is that the more we UNDERSTAND all sides of an issue the more likely we are to find creative solutions.

I don’t think anyone knows the answer . . . We’re a bunch of mice in a HUGE maze.

How can we understand? We TALK to each other – spin ideas – Continue the conversation Locally with a solution-oriented Spirit.

Is there really a solution to any of these problems? It all starts at the National then works down to the local level. Our only hope is the local level.

Barry,How far is Tennessee from NJ? If I can make it in an hour I will be there.What I find is that every short sale Reo etc.  is a little bit different.When you submit your offer is  when you find out (true or not)that there are multiple offers already on the table. It is not marked attorney review, so this is obviously a strategy. The previous   offer that we made on another short sale was much better. The bank only entertained one offer at a time and it was ours. So that was a good thing. Caprice

I'd like to hear 'afterthoughts' of that conversation.

I tried to search AR for homepath experience sharing, not much...:(

I submitter two different offers  on homepath.com thinking that the process is supposed to be transparent, but it is not..i'm becoming confused...someone else is accepted and I was not notified about multiple offer situation....ha?...my question: can a listing agent ignore offers that submitted online and accept the offer based on a personal preference?

Inna - We had a great conversation and discovered, in large part, that there's still a lot of uncertainty in the process with Homepath (and many other Foreclosures).

Best I can tell, there are very few rules, and the listing agents have little (if any) control over what happens.

The best way to go about any of these with a Buyer is to always go into any offer with a "Highest and Best" offer as soon as the Buyer is ready to make an offer . . . and NOT to be "invested" (emotionally or financially) in getting the property.

Event the bid deadlines often don't hold water sometimes . . . Sometimes it appears they are making up the rules as they go . . . and making decisions based on what they had for breakfast that morning.

There's an opaque curtain between what the asset managers do and what we see . . . and it seldom makes logical sense.

I consider all of these transactions to be more "at risk" than open market sales and I make sure my client understand this before diving in.

Another frustration is that the listing agents will often leave the listings in "Active" status even though there is an accepted offer. I have one client who sends me daily emails with links to properties he is interested in . . . 98% of them are under contract when I check the Homepath site,

All of this to say . . . If you're going to play in this sand box, it'll be a random and unpredictable experience . . . and I see no signs of this changing any time soon.

Exactly...

my experience with homepath ( time: for last month till this morning)

found REO,

submitted offer next day: full package, above asking price, financing they wanted

next day - the house is under contract, my offer ignored( never had acknowledgment or any reaction on it)

house BOM in a week, we submit a stronger offer ( by terms)

multiple round- after one week: rejection, no comments,

house under contract

in a few days: it is BOM

we submitted offer again!

few days it is under contract AGAIN

my offer is still ACTIVE, never had any comment or rejection

few days passed, again: house BOM

having the previous offer sitting there, I submited again !

Two active offers are sitting there - this morning the house is listed under contract!

NO reaction again on my offers!

I call agent- NO reaction: no answer, no calls back.

 

I watch my first time buyer going koookooo. His kids are about to start schoool;

the tiny fixer ( required tons of work) is going back and forth under contracts with someone else  and his agent( ME) has no comments:(

 

Well, I'm personally offended and feel powerless in this situation( yes, I'm upset too. Because i'm totally ignored. It would take one call /email back just to acknowledge my existence in this world. Does she has pleasure treating other agents and their clients like that?
