I am mentoring another agent.  Her client is trying to build a new home from CBH homes.  They walked into the office and worked out the contract with the CBH agent the terms of the contract.  The sellers agent wrote the contract up with $1500 in the design studio (for upgrades).  We never had a chance to set the terms of the offer since it was complete and our clients had agreed to those terms.  Our clients signed the offer and they countered taking away this money.   This seems to me to be bait and switch.  If we had asked for this it would have been fine for them to counter but they wrote the contract not us.  I am advising that we counter with that money in.  The kids are afraid of losing the contract but they really could use the money so they can have things a house SHOULD have standard... Like a non shallow sink.... A closet door.... A 6 lb carpet pad....

Sounds like they helped you get your client into contract, helped them make up their mind and try to get some seller concessions. Doesn't sound like to bad of a deal.

Actually they basically put my client in the contract without our negotiating anything.  Then they took away something they said they would give them.  I call that bait and switch.  If I am working as a buyers agent I feel that I should represent my client.  If I had asked for the concessions and they refused I would consider that a negotiation.  Since they put it in the contract I call that dubious.  I also am signing my name on what I write.

In all the CBH Homes I've sold i've never known the agents to be able to make concession decisions. Just like we don't with our Sellers. Seems like they have always just suggested what might be accepted based on other deals. So they can't bait and switch something if they can't promise it. I'm sure your client knew it was not promised. I've always known the CBH agents to be helpful and understanding that we are all busy agents. If they can help us show less homes and write deals then it's great. Did they give you or your mentor a chance to review the contract and offer suggestions prior to submitting it? Not prior to getting signatures but prior to presenting it to the seller? In the end it's not really about us but about our clients! I can tell you are a good agent who cares about your client. Most importantly you remain excited and supportive of them! Show no doubt in the product or company they chose. They depend on you! Cheers to you as a good agent and cheers to making more homeowners happy! Good luck this summer! Things are picking up!

Thank you for the information.  We countered and asked for the money back.  We will see what happens.  It is ovbvious you are also in the Treasure Valley and have more experience with CBH Homes... I assume they will either accept or counter and not quash the deal.   The kids want the house and it is frusterating because this seller concession (that was suggested by the builders agent) would be very helpful to help these kids get the home they want.

Yes, sold a few CBH Homes! Seller concessions are ALWAYS helpful and I'm sure would be nice in your clients situation. It's a Sellers market right now and even banks aren't giving much! I play it safe and set up my clients expectations to pay full price and anything we get would be AWESOME but if we don't get anything we find a way to make it work and get the house they want! 1,500 shouldn't make or break the beautiful home they will be building. In my most recent CBH build (2weeks ago) 190,000 build, we didn't receive any concessions either. If it makes you feel better construction costs are rising. Good luck and it will all work out the way it's supposed to!
