I had a listing many years ago where the seller was a 80 year old woman. The title report showed her name as well as names of her late husband and her inlaws on the deed.

The title company  wanted proof that the woman was not divorced at the time of her husband's death and also show death certificate for the husband. They also wanted proof that the inlaws were not divorced at the time that they died and show proof of their death. The inlaws had co- signed for the loan. She did not have any children but had a nephew who helped her.

My client started crying when I asked for information. She could not find the death certificate for her husband .We did not have much time to get all the information. I have had sellers prove that they are divorced but never had to prove they are not divorced.

I did not know where to begin because my client was upset.

I found out the name of the funeral home where they had  her husband's funeral and they looked up their records.  I called the local newspaper for obituary information for the date. I assumed her inlaws must have had their funeral at the same place and asked about it. It took them a couple of days to look up records and they gave me the exact dates and information about inlaws. I gave this information to the title company . This helped them get records that they were looking for.

With help of title company, newspaper and funeral home I could get the information and had Happy Buyers and Seller.

Proving a negative must have been a challenge!  Thankfully, you were able to get a team together to get the required documentation.  Good for you!

That the inlaws of a n 80 year old might still be alive isn't as wild as you might think.  The last widow of a Civil War Vet died in 2004, 140 years after the end of the Civil War.

Gita, And you show how you go above and beyond what many other Realtors do and how you were able to "save the deal"!

Gita: Another good example that shows the various hats a Realtor needs to wear to keep deals from falling apart. Good job of doing some investigative work to find the missing documents.

Judith, I agree but asking a woman that old to look for records of inlaws was difficult.

Larry and Sheila, That is part of our job description.

Anita, Thank you.

Don't they have those records on file with the county?  Hmmmm . . . never ran across this, but what a good solution.

Carla, I did not know where to begin. It was easy as I got it done by a few phone calls. The title company wanted the dates . Maybe if they had dates they could have gone to the county. But they wanted seller to provide the information.

Great job Gita.  You took care of your client very well.  Now, that's going over and beyond the call of duty.

I can only imagine how emotional this was for your clients. Knowing that they are, and dealing with the loss is hard enough. But then having to prove it too? Wow, good thing you went to bat for her.
