I had a listing many years ago where the seller was a 80 year old woman. The title report showed her name as well as names of her late husband and her inlaws on the deed.
The title company wanted proof that the woman was not divorced at the time of her husband's death and also show death certificate for the husband. They also wanted proof that the inlaws were not divorced at the time that they died and show proof of their death. The inlaws had co- signed for the loan. She did not have any children but had a nephew who helped her.
My client started crying when I asked for information. She could not find the death certificate for her husband .We did not have much time to get all the information. I have had sellers prove that they are divorced but never had to prove they are not divorced.
I did not know where to begin because my client was upset.
I found out the name of the funeral home where they had her husband's funeral and they looked up their records. I called the local newspaper for obituary information for the date. I assumed her inlaws must have had their funeral at the same place and asked about it. It took them a couple of days to look up records and they gave me the exact dates and information about inlaws. I gave this information to the title company . This helped them get records that they were looking for.
With help of title company,newspaper and funeral home I could get the information and had Happy Buyers and Seller.
