Texas is a Community Property State.

If you are considering a move to Texas you need to know that Texas is a community property state. That means any property acquired during a marriage will belongs to both spouses. It doesn't matter if you bought it as an individual investment or to live in it belongs to the both of you. It does not apply to out of state property unless that state is also a community property state. That means both of you will have to sign the dotted line if you buy or sale the house in Texas. We come across this quite often. There are some out of town investors who are not legally divorced, but are separated. We make sure we inform them of the community property statutes.

California is too.  I am a notary republic signing agent on the side and I run into this all the time.  The Community Property Survivorship vesture is better for those that worry about tax implications upon the death of one of the spouses. Good post and reminder.

My sister is going to file for divorce. my brother in law has told her that he has taken her name off of their property(30 acres in Hardin , TX) can he legally do this?
