FAQ about Real Estate in Southeast Oklahoma:  Questions about Mineral Rights

faq mineral rights oklahomaIt is quite common to be asked about Mineral Rights in Southeast Oklahoma.  The questions vary sometimes but one of the following usually covers it:

1.  Are there any mineral rights included with the sale of the property that you have listed?  It is rare that 100 percent of the mineral rights will be included with the purchase of surface rights of any of our listings.  Sometimes the sellers do not even know for sure if they own any.  Standard contract wording currently reads that mineral rights that the seller owns pass with the property unless previously reserved.  If you want to know for sure what mineral rights are still attached to the surface rights, you will need to do either do mineral rights abstract OR have a title search done specific for mineral rights.  

2.  What is a Mineral Rights Abstract?  A Mineral Rights Abstract is a "book" of copies of all documents have been recorded with the county governent that affect the ownership of the mineral rights specific to a legal description.  

3.  Who builds a Mineral Rights Abstract?  Abstractors are certifed through the Oklahoma Abstractors Board. 

4.  I inherited the mineral rights for a property in Southeast Oklahoma.  Can I sell them?  Of course.  

5.  What should I do to sell the mineral rights on a property?  Usually the best way to start is to call the county court house clerk's offce and ask about companies that may be currently buying or leasing mineral rights in that county and ask which attorneys in the area work with mineral rights.  Then retain an attorney to handle it for you. 

6.  When I sell my property, how can I reserve some of the mineral rights?  The easiest way is to reserve whatever percentage you are keeping when the deed is prepared for the new owners.

Judi-your post made me a little homesick for Texas.  I have not heard mineral rights mentioned in years but growing up in Houston, mineral rights was always part of a conversation involving land.
