When working with buyers for a new home in Newburgh NY I
frequently get asked about a Home Warranty. Most question “if” the builder is giving a warranty, rather than “what does the builder cover”. The expectations are not always there that a warranty even exists. I have actually found that to be a bit surprising. New York State law has taken away a good deal of the concerns as it requires the builders to provide a warranty on all new construction homes. New York State law works to protect the consumer by placing specific requirements on the builders of how the warranty works, and is required to be included.

  • One year’s protection against faulty workmanship and defective materials
  • Two year’s protection against defective installation of the plumbing, electrical, heating and cooling systems
  • Six  year’s protection against structural defects

DocumentsBuilders provide a copy of the details with their set of contracts for review. Your actual warranty is given at the transfer of title. The details spell out the process for any grievance and how to handle any problems along the way. Important to look for is the deadlines any protocol for the process. The warranty does not cover any construction done by the homeowner.

Dorie.. sounds like  you made a great move to Austin.. My daughter almost moved there and I was hopeful, but she never ended up in Austin.. and now she is hoping to get back to California.  Schenectady is super cold! Newburgh works for me except for winters. but we are close to NYC and that is fun! Our new home owners are protected with the new laws...We also live in a town that has really strict codes for the building and they really enforce it so buyers are protected.

Warranty laws exist in many states. Bigger problem is making sure the builder is still in existence under the same corporate  name. Here today, gone tomorrow even though they are building down the street, but now a new company.

Erv ~ Very true.. that is why having a builder that is local and has good references is a good idea. Even if they change their name, the reputation on the street if they don't honor a contract will catapult them out of business in a flash.
