How Long Does a Seller Have to Respond to My Offer?

Seems the ink has barely dried on an offer before my buyers ask me, "How long does the seller have to respond to my offer?"  Some buyers may be under the impression that sellers have twenty-four hours to respond to the offer.  I can assure you, there is no such time frame in Northern Virginia real estate.

One of the statements in our Northern Virginia Real Estate Contract is that "time is of the essence."  What the heck does that mean?  Your guess is as good as mine.  As a Listing Agent, when I get an offer, there is a certain prioritization of getting that offer to the seller.  Some agents may feel that their trip out of state for the weekend trumps the offer and present it when they get back two or three days later.  

My best advice is that if you have a time frame in which you want, or need an answer, put an expiration date and time in your offer.  And be specific.  Don't say, "This offer expires in 24 hours."  Starting when?  It's better, for instance, if you are writing an offer at 6pm on June 1st to say something like, "This offer will expire, if not accepted or countered by seller in writing, at 9pm on June 2nd."  

Consult your own agent for their opinion on whether or not a deadline to an offer is a good idea.  In some circumstances, they can be counter-productive.

Always an essential to be as clear as possible, as to intent, in a contract...time limited offers need to be spelled out.   Good advice!

In California the standard purchase agreement specifies that the offer expires by 5 PM on the 3rd day after the Buyer signs or as specified . . . but often ignored on the seller side especially on bank owned homes.

William:  Bank owned homes are an instance where you might as well go try to move a mountain if you are expecting an Asset Manager to respond in 24 hours.

Chris Ann,  The Colorado contract has a specific date and time expiration on offers.  With eContracts, the sellers should be able to respond quickly.

Good afternoon Chris Ann, It sure makes a difference if the seller is owner occupied, a short sale or a bank. With owner Occupants placing a time may speed things up but during a short sale or bank owned home sale, it may get their offer rejected by placing an expiration day. Have a great Saturday

Belinda:  In this digital age, there is no excuse for holding onto offers and not being able to review them.

Scott:  Expirations are a double edged sword, that is why it is best to consult with your own agent.  Hopefully buyers will have hired someone that is well versed in the pace of the marketplace.

We have the expiration of the offer already built in to our contracts, we just have to write in the date and time.  Of course, getting the sellers response is another thing, but then we have another little check box that if the acceptance or counter is received after the expiration the Sales Agreement is still in force.  I can't imagine an offer with no expiration date/time??  WOW.  So your contracts don't have that in there unless the agent adds it?!?  HOLY LIABILITY.  What if, the agent doesn't put that in and days, weeks, months later the seller accepts?

Hi Chris - Normally when I am ready to submit an offer, I check with the listing agent to see if the seller is in town and their availability.  That will determine my expected "time of acceptance."  It is not uncommon in Atlanta to put in 24 hours if the seller is in town.  Our contract has a place for the date and time that agents fill in.  I cannot image not having that automatically in a contract and agree with Carla - that is a major liability without automatic inclusion.

Chris Ann~ Our Contract to Buy and Sell Real Estate actually has an acceptance deadline date and time.  Of course, that doesn't mean that we actually get a response in that timeframe, however the contract is considered dead once the date/time expires.
