Complicated Condos, Crises Cases and Creative Conclusions

Complicated Condos, Crises Cases and Creative Conclusions

Our team has had the good fortune to list and sell an average of three or more condos a month these last several years.

We have discovered that there are a lot of complications involving the sale of  condos in our area.

Many of our transactions have encountered crises that we had to solve.

Each of these sold, but often they needed creative solutions to take us to closing.

Here then, are 17 of the stories we have encountered in the Puget Sound area listing and selling condos the last several years:Condos sold by the Phil Leng Team

Bank-owned Condo Problem 1http://actvra.in/BxW
Self managed condo. Stealth board. Inactive in the extreme.

Bank-owned Condo Problem 2http://actvra.in/BxV
$5000 assessment one year. Double the HOA dues the next year. Lots of unhappiness to spread around!

Bank-owned Condo Problem 3http://actvra.in/BxT
There was a lawsuit. The HOA was suing the developer of the entire condo for shoddy work!

Bank-owned Condo Problem 4http://actvra.in/BxS
Own a car? This condo was not for you! Nowhere to park in the unit. Nowhere to park on the street.

Bank-owned Condo Problem 5http://actvra.in/BxR
The case of two addresses. I notified the wrong unit that their condo was in foreclosure!

Bank-owned Condo Problem 6http://actvra.in/BxQ
Big IRS lien three times as much as the condo price. Closing was delayed three months, but we finally closed!

Bank-owned Condo Problem 7http://actvra.in/BxP
There was an assessment of $21,400 to be paid by buyer after closing. They did, and we closed!

Bank-owned Condo Problem 8http://actvra.in/BxN
Condo was foreclosed even though there was a short sale offer in place. The condo also had no rental cap, so investors were buying many units.

Bank-owned Condo Problem 9http://actvra.in/BxM
A townhouse on two alleys. No street at all, and no parking other than in the one car garage. There was a strip club a half a block away.

Bank-owned Condo Problem 10http://actvra.in/BxL
The dues were high - $500 a month. The views were bad - a cement wall and a parking lot. We found the right buyer for this unit!

Bank-owned Condo Problem 11http://actvra.in/BxK
The commercial bank was foreclosing on the developer, who had only sold a third of the units. Meanwhile, our listing, which was individually owned, got foreclosed on by ITS bank. We sold it quickly and it closed smoothly...

Condos require a little more labor than lets say a stand alone home...Some agents handle it well while others go through the motions. The CC & R's should always be available and consulted right away...Read the small print and ask lots of questions. Finally, talk to people who live there

Condo associations are hard to deal with. Resident officers are not professional managers. Hired management companies don't live there and generally do not care.

Thanks so much for your comments.

I would not have believed, three years ago, that so many different things could go wrong with selling a condo.

Just when I think I have seen it all - dealt with it all - there is another unusual issue that has to be overcome.

One of the cases I did not highlight involved a condo in the path of our light rail. We had to sell it, knowing that it was going to be knocked down in a year or two!!

I compltely agree that condo sales can become quite complicated as implications with different aspects of the condo building or financing can make the purchase quite difficult.

Being able to work through the problem no matter if its a condo association issue or something wrong with the apartment itself is always the most important part of getting the transaction to close.

Thanks for the comments.

Sometimes because of the problems, only cash or HomePath (if it is a Fannie Mae property) will close. Our latest one had the roof, siding, windows and decks all replaced. Problem is, they had no money, so it was all financed. The new buyer had to take on $206 per month for 10 years on top of the normal dues because the HOA had not saved up for repairs.

Great job in overcoming all the issues with the condos, Phil!  Isn't it rewarding to be able to come up with creative solutions?

Hi Beth,

It is rewarding, but it drives you nuts sometimes. One we have in closing right now was an all cash sale that flipped the first time, because the buyers were buying it for the family when they were in town. Because only one couple can live in it to call it owner occupied, the HOA said it would be considered a rental even when no rent would be paid, and that would exceed their rental cap. The people moved on...
