A contract is only as good as the parties who sign it?

Sad but true.  I have come across a few transactions recently that have almost allowed me to loose faith my fellow agent.  However, I am keeping the faith because I know for each "bad" experience I run into working with a less-than-stellar agent,  there are many other transactions where I am privileged enough to work with truly skilled & professional REALTORS.

I just closed a transaction with some of the most wonderful Buyers ever.  They had done everything they were asked to do and were very open minded to keep negotiations fair.  After the contract was ratified they met every deadline and asked all of the right questions.  After the home inspection revealed many defects, they determined which items they would truly not be able to buy the home unless they were fixed/researched more.  They whittled down the long defect list provided by the home inspector to just a few items which the seller agreed to correct.

Fast forward to the pre-settlement walk through.  One of the major issues to be corrected were 7 rotting window sills.  The Seller agreed to "replace rotted wood" and even provided a receipt from a service called Handymensch (clever name, not clever service!).  But upon inspection we noted that only 1 of 7 sills were actually replaced or even repaired.  When we contact the Seller's side we were pretty much told  "too bad".  Really!?

Now at this late in the game, I suppose the seller feels pretty confident that the buyer will simply shrug their shoulders and say OK.  In this case, the buyer was not a push over and was ready to walk.  In the end I was able to offer a solution that was acceptable to my client, but with absolutely no help or consideration from the Seller's side.

So I wonder,  when did following the terms of a contract become optional?

You are so right, some and most are great experiences --- but every now and then - something will happen to make you ask why??  Keep the faith, someone else will teach them to be more careful with their work.
