This lot was listed for 3 years with another Realtor and never got approved!
I finally was handed the deal by a fellow realtor in my office and I went to work on June 8th, 2012.
First, I submitted a complete short sale file to Bank of America and included latest comparables thru equator.
Next, BofA calls for a BPO and then they start SHORT SALE negotiations.
The latest sales in within 3 miles of subject were $6500, $6500, $10,000, and $12,000 all in the last 90 days.
The offer was for $10,000 which we believe actually more than fair market.
The bank calls and says great file however we have an issue... there is a LITIGATION HOLD on the file. I ask for details and they said at some point, the homeowner was represented by a lawyer for foreclosure defense.
If I could get a written withdrawal, we could then proceed.
I look online and sure enough RECORDED in the Clerk site is a hearing that took place 2 years ago that was a motion to withdraw and it was granted and recorded in public records.
I download the copy and send to my negotiator. 10 minutes later, she sends me a counter offer of $12,000 on our purchase.
I again reiterate the comps and she continues to argue.
After 3 hours of back and forth and letting her know I would rather let it go back to the lawyer, BofA agrees in writing to our original offer and we have a deal at $10,000.
So to summarize: 3 years with another agent that doesn't specialize in Short Sales but instead in REO's.
