They Can't Do That - Real Estate Agent Training TipsTenants. Washington, DC has some of the toughest tenants-rights laws in the country. It's almost as if you have a tenant for life...and it doesn't even matter if they are paying their rent.

Selling Tenant Occupied Properties

So when it comes time for the seller to sell a property that is tenant occupied...it takes our jobs to an entirely different level. As with everyone else, tenants can be great to work with or they can be extremely challenging. Great tenants will keep the property tidy at all times (or at least most of the time) and will allow showings with a reasonable amount of notice or in specific time frames. They return the real estate agent's telephone calls or emails and are generally very cooperative.

The Challenging Tenant

Then we have the challenging tenants. Now we all understand that the tenant is being displaced and often times is not pleased about being displaced, but it is not our decision to sell the property...it was the owners decision and we were hired to get it sold. As real estate professionals we try our very best to be accommodating and respectful at all times. But the tenant is angry and wants to make things as difficult as possible for not only the owner, but for the real estate agent as well. Because we know this type of behavior occurs, we try prepare the owner for the worst.

  • We let the owner know that the tenant may not allow showings or may require too much advance notice
  • We let the owner know that the tenant may not allow an agent in the property, even with an appointment
  • We let the owner know that the tenant may not keep the property clean
  • We let the owner know that the tenant may change the locks

What Are You Willing To Do About It?

Yet, even when you tell the owner all of these things, the general response we hear is, "They can't do that! That will be in violation of their lease"! But the sad truth is this... they WILL do these very things and it doesn't matter what the lease says. And unless you, Mr. or Mrs. Owner are willing to take legal action, there is virtually nothing you can do about it.

Jason...a tenant can be a major stumbling block to selling a home...usually messy, not always in their best interest to sell...they can cause all kinds of issues. Good post.

Hey Jason,

Thanks for the re-blog!  This is a good post.  A few tenants in Georgia refuse to allow showings at all even though the property is for sale.  Best of success to you this year!
