8 Comments on California financial elder abuse law in the real estate context
VERY IMFORMATIVE AND FULL OF FACTS. However, some folks will have to have a Legal Background to comprehend all of this information. It just might be a **Bit Too Much** for most people to absorb.
Stating all those cases, is just way beyond too much for MOST PEOPLE. Myrna :) :) :)
Elder abuse is a problem and it's important for us as real estate pros to be aware of it.
Good public service. Many elders or their care givers don't know where to find this info. The case law reviews are great.
I hope this makes the rounds over the Internet and lands in all the right places...Let those who practice nefarious deeds take note also....Most excellent post and public service as my colleague Lenn in summer cubicle #3 shares...
I am writing a more general blog about elder abuse which might be easier for us realtors to understand. If people think there is elder abuse they should report the abuse to Adult Protective Services in Alameda County. My husband is an elder law attorney who has seen what appears to be elder abuse. He is not an elder abuse attorney so he refers those matters to an attorney who specializes in elder abuse such as your firm.
Steve, there's a lot of great information in this article. I'm on a computer with a small screen so I only made it about half way but have bookmarked it for reading later and have subscribed to your blog.
I retired from working for the California trial courts in 2007. I specialized in probate (including conservatorships, guardianships & trust matters) for 15 years so I've seen many elder law cases where fiscal abuse was alleged or proven. We've even encountered it within our family and had to put a stop to it. I wish there were more education in plain language available to the average person on this subject because elder abuse, both physical and financial, is rampant in our society and is only going to grow as the population ages. I'm no longer a notary, but on two occasions I refused to notarize documents because the elder had no idea what they were signing at the time I was there. Not knowing what else to do, I reported both of those attempts to the local APS. As real estate professionals, we need to be aware of these issues both to protect our clients and ourselves.
Thank you everyone for the nice comments. Next time I will condense the article as I realize from the feeedback it is a bit much. Just got on a roll reviewing cases. Steve : )
Recalling case law as sited will not be done as much as recalling your name and location for providing such a service to us for enlightenment. Thank you for taking the time and patience.
Caretakers everywhere should take note.
