Listing Agreements with Sellers

A listing agreement is an employment contract between an owner and a real estate broker. The listing broker may be a single agent representing the seller or a transaction broker with limited representation, or the broker may have no official brokerage relationship with the seller.

Listing brokers and sales associates do not have the authority to sell or convey listed properties or to accept or reject offers to purchase unless they have power of attorney to do so. Brokers use three basic types of listing agreements in Florida: open list­ings, exclusive agency listings, and exclusive-right-of-sale listings. Licensees sometimes use net listings with any of the three types of listings, but generally avoid them.
