Should You Stop Making Payments To Do A Short Sale?

Good question. And I don’t have the answer nor would I ever suggest you miss payments. But I do have an opinion based on my own experience.


First a few facts:


  • Missing payments will mess up your credit.

  • Missing payments is no guarantee of a short sale approval.

  • Missing payments could cause you to be foreclosed on.


However, if continuing to make payments is harming you and your family's future AND it is certain that you will not be keeping the property, then why continue to throw good money after bad?


Being delinquent on your payments will certainly help to prove a hardship. Plus your loan will then become a non performing asset and the investor will have to do something with it. A Short Sale is almost always their best option. They will not foreclose out of spite. They will dispose of the non performing asset in the way that limits their loss the most. That's a Short Sale.


I did Short Sales on 2 of my investment properties in 2010. I was delinquent and did not have to bring any money to closing. It was the best thing I had done in a long time. My only regret is that I didn't do the Short Sales sooner and I wish that I had done Short Sales on my other properties instead of selling and bringing money to closing.


By trying to "hold on" I cost myself thousands of dollars that could have been used elsewhere. My credit was damaged and is still damaged. But you know what?


It forced me to evaluate my complete financial picture. There’s a reason I got into the mess I was in. And it had nothing to do with the lenders “screwing me”. I got into the mess because I borrowed more money than I could ever of  had a realistic chance of paying back. Paying it back was dependent upon outside factors i.e. tenants paying rent and values increasing. If either of these went wrong I was screwed. And of course we all know what went wrong.


Sure I couldn’t have predicted the Real Estate crash of 2006 but I could have been in a position where it would not have mattered as much.


I went from owning 6 properties and almost a million dollars in debt to owning nothing but my home, which was bought using private financing after my Short Sales.


My home is half the size of the one I used to have. My auto is paid for. And I have a total of $100,000 in debt. This includes the mortgage on my house that has roughly 20% in equity.


My business is booming. I have zero financial stress and I'm getting ready to take a month off. That will be my third vacation this year after not having one in the last 15.


Maybe, just maybe, the Short Sale can be your beacon to a better life.


Moral of the story: Don't be a slave to your credit score and debt. Make a difficult decision now and get on with your NEW life.

I too am finding that the investors are wanting the sellers to be delinquent more than they did in the past. Hopefully this will change with the new FHFA guidelines that come into affect November 1st.

Bryant- I love your story and happy that you shared it. It is important to share these stories because so many people think they are the only ones facing the same decisions you faced. Being free and almost debt free is a great feeling. People get enslaved to their credit scores but there is so much more to life than credit scores. Have a fun vacation.

BB - You have listed well the pros and cons of missed payments.  I have a cousin in another state, who told of continuing to make payments on a home significantly upside-down.  He first tried for loan modification to no avail.  Then tried for short-sale.  The bank "encouraged" him to miss payments.  But the minute he did, they immediately tracked him for foreclosure.  I understand that bank servicing agents, often encourage miss payments, because they get paid more each month for servicing a "troubled" loan!

I short saled 1 of mine rentals back in 2009.  Messed up the credit but I agree better to do it sooner than later.  If you short sale when everyone else is doing it, the creditors and the economy are probably going to be a lot more forgiving than if you wait until nobody else is doing it.  Since then I have slowly built up cash reserves and have able to successfully flip a ton of homes to investors - I buy for cash and typically resell for cash.  Also doing refinances under this HARP 2.0 program - with the short sale nearly 3 years behind me, banks are willing to do refis with me now.

And, of course, no whining about losing properites is quite fresh.

We did not have properties besides our condo, but wanted to get into something big, and got cash out of it, thinkjing that the new business would help paying the increased mortgage, and it didn't, and yep, we had to go short sale, move into a rental, and only now bought a condo with private financing.

You're so right! So many people are so terrified of harming their credit (I used to be, too) that they won't actually take the more fiscally responsible step of letting go of something that's dragging them down to a point where it might be much harder to recover. Is it a hard step? Does it take swallowing some pride? Yes and yes. But is it the best thing to do for your financial future? Most times, also yes.

Same applies here- though with consequences and circumstances admittedly much less perilous.  The point is that as I process applications homeowners-turning-renters submit to me, they can be divided into only a few categories:

1) Folks have continued to make their mortgage payments and paid no other bills

2) Folks have paid every bill but their mortgage payment

3) Folks who tried #1 and couldn't keep up with that.

Obviously, the folks falling under #3 are in the worst shape.  Though it has to be incredibly difficult from their perspective as they're living the realities of their circumstances, I can read what's transpired in about 40 seconds and say "These guys should've let that house go a long time ago- and used that mortgage money to pay something!"  Prioritize as you wish, but as I see it, there's nothing good about submitting an application that shows you have a job- with a credit report showing that you haven't been paying on anything.

In those cases, don't expect to rent a place from me without a double deposit (at minimum)- and please don't feel offended when I request it.

BB- thank you for sharing this information and also for not assigning all of the blame to the banks and lending institutions.  I remember someone speaking at the Realtors Assn of the Palm Beaches a few years ago and he told us a similar story.  He turned things around and I think because of this is in a better position to help others.  A few years ago I referred a Realtor who specialized in short sales to a client.  She and her husband had lost their jobs and been looking for work for over a year.  They'd tried to get their lender to talk to them and see if they could work something out with the payments.  They were still paying their bills including their mortgage but realized that if they did that they would soon go through their retirement savings. Their Realtor was able to get the lender to discuss a short sale and in a short amount of time the house sold and they moved back to their home state.
