You know, I wake up every morning and the first thing that comes into my head is, "What can I Blog about today?" Trying to write 4 or 5 posts a week, is very difficult, when you are always trying to be original and also trying not to write about things that have already been written about. So every day, I start the day, worrying about it. Then the phone rings and my worries are over.

"Good morning, Tutas Towne Realty, this is the incredibly good looking and intelligent Broker Bryant speaking, how may I help your dreams come true today?"

"Hi Broker Bryant, this is your Seller over at 4321 Desperation Ave. I'm calling to let you know I have found a Buyer for my house. My neighbor, who has lots of money, wants to buy my house. I know he has lots of money and can pay cash for it, if he wants. I told him I would only take full price ($259,000) for it but at that price I would leave the appliances. He said something about putting 5% down and me giving him back a check for $15,000 at closing and he wants me to pay all his closing costs. He has lots of money though. I'm really excited about this and I told him he needed to give you a call to do the paperwork. He has lots of money and wanted to buy my house before he bought the one across the street but it wasn't for sale then. He has lots of money."

"OK, OK, Mr. Overwhelmed, the first thing we need to do is have him call me. I need to talk to him about his qualifications and make sure he is in a position to even purchase your home. Then we can get his offer in writing so we can sit down together and go over your options. By the way, you can't just give him money back a closing, that could be mortgage fraud and we can't do that. But we will worry about that after I get a written offer from him. OK?"

"OK, but I know he has lots of money. I told him I was in foreclosure and he said he could help me out. He really likes the house, since it is the best house in Poinciana, and he has lots of money."

Anyway, I received a call about an hour later from a REALTOR®, all excited, wanting to submit an offer on this listing. She asked me the price and I told her it was "Range Priced" from $239,000 to $259,000 with $259,000 being a full price offer. She didn't understand this so I took a couple of minutes to explain it to her. Her excitement seemed to escape her, at that point, as she said, "Broker Bryant my Buyer would like to offer $225,000 and wants the Seller to pay $14,000 in closing costs. He will be getting 100% financing. Do you think we have a deal? He said he has already talked about this with the Seller."

Now folks, does this offer sound anything like what the Seller had mentioned to me earlier? Of course not. They never do. Desperate Sellers hear what they want to hear and say things they shouldn't say and Buyers will and do try to take advantage of the situation. Why would you tell a potential Buyer you are in foreclosure?

This is one of the most important reasons to hire a REALTOR®. We are not emotionally involved in the deal. We are a calming force and we are trained to weed out unqualified and unrealistic Buyers. Without a REALTOR® looking out for him, who knows what kind of a deal this Seller would agree to? You can be sure it would have cost him a lot more money than what he is paying me. And he probably would have unknowingly participated in Mortgage Fraud. This assumes he wouldn't have wasted months and months of market time, while the neighbor, with lots of money, tries to sort out 100% financing on a second home.

Hiring a professional REALTOR® who has experience and market knowledge in your area, is the best investment you can make. So before hiring a REALTOR® to sell your house ask these questions.

  1. How many properties do you personally have listed on the market in my area, today?
  2. How many closed transactions did you have in my area last year?
  3. How many pending transactions do you have in my area, today?

There are many more questions you need to ask before hiring a REALTOR® but, in my opinion, you need to have the right answers to these three, first. And make them show you their sales record from the MLS.

By the way, I never did hear back from the Buyer or his REALTOR®. I guess I need to call Mr. Overwhelmed back and let him know the neighbor has no money. Better yet, I will send him a link to this post.

I wonder who will call me tomorrow morning?

Dear Consumers: If you are reading this post never try to negotiate with your neighbors. And what ever you do...Never, as in ever, let a Buyer know you HAVE to sell your house. That's a bad move guys. Let the Agent you hire take care of the details. The Agent is not (and shouldn't be) emotionally involved in the transaction.

Back to you Darlin' (Broker Bryant) never worry about what you're gonna post. You always, as in always, get these calls. :)

Bryant, that is like the Borrowers that I talk to that have great Credit until I look at the Credit Report.  And the selective hearing is something that I have become very use to.

Mr. & Mrs. Borrower do you realize that the monthly payment represents 65% of your gross income?

Yep we know and we NEED this house.

Are you sure you realize what this means to you monthly?

Yep and we can handle it.

OK, I can't make the decision for you, all I can do is try to make you understand what you are doing.

What happens a year later is something we have all heard to many times, and it isn't their fault, it is everybody else’s fault.

You nailed the problem, especially when you already HAVE a Realtor®. BB I wish for you a carefree phone week next week, although, what will you blog about :0)

Jeff, "show me the money" is my favorite line. I loved that movie!!! This guy is a real chatty catty plus he is home all the time. I almost turned the listing down because of it. I knew it was going to be an issue. But he is a nice guy and they really need my help protecting them from the preforeclosure sharks. Hey at least he called and didn't try to cut me out of the "deal" like the buyer wanted him to. 

Carole, one good thing about our business is we will NEVER run out of things to write about.

TLW, quit soliciting money from Stan. Ok maybe just a little:)

George, selective hearing is rampant in our business. Comes in handy in marriage too:)

Stan, you caught that? :) I actually tried to explain to my seller that people with  "lots of money" don't finance their closing costs for 30 years and ask for a check back at closing. He was too busy talking to "get it" though.

Bryant,  I've had situations where an agent will call and say they have someone really excited about the home and is going to make a good offer.  Sometimes I might even be in the middle of negotiations with another contract on the same home and they beg you to stall until they have time to submit their own offer.  When their offer finally comes in it is a ridiculously low offer with all kinds of stipulations. I've learned never to wait for the "great offer".

Everyday brings inspiration!  Desperation however, never brings desired results.  It is hard for some in our community to fathom what our local market has been like. While some Realtors nationally are doing quite well, here it is a very different story. So I enjoy the local flavor of your post...have heard it so often out in the field...and yes, the neighbor "with money" turns out to be "Lire" as my Italian father in law used to say!  Enjoyed the post!

I enjoy telling selers to say these words to anyone about anything other than the sales price. "Talk to my Realtor".. I make them say it over and over, with examples.. I'm a buyer, and I'm asking how long its been on the market, what do you say?  "Talk to my Realtor".. even then, people still spill their guts.

I think I will be rang pricing my appraisals.. $250-$325, $325 being a full report with all comparables, photos, sketch and final value!! haha... thanks for the idea! :)

While it is a great idea for sellers to "plead the 5th", there's no way they will keep their mouth shut.  It is AMAZING how much a person can discover with a few, well phrased questions; especially when it comes to the neighbors.  It doesn't matter if they love or hate the seller......they yak.  Every tidbit of info helps in the upcoming discussion to lower the seller's expectations......but, I'm just a poor 'ol country boy so what do I know.

Stan, you got that right. The best thing for sellers to do is leave. Keeping quite is just not possible. I've had several deals this year where the seller negotiated the entire deal and then calls me to say the other Realtor will be faxing me over a contract, with out fail, they leave thousands of dollars on the table. They hire me to do a job then they slice their own throats. One can you do? Get paid and move on.

I really appreciate all the comments everyone. I'm sure every one has experienced this before and will again. It's the nature of our business.

I ditto Nick's comments.  I learned the hard way some 15 years ago and have never made that mistake again.  I play completely ignorant now, blame my ignorance on my wife, and refer the questions to my Realtor.

Hi Stan.. sorry to reply so late.. I've been banned from the PC this long weekend.  I agree with your statement. But I still have to tell people to stay quiet. I have had a few that actually listen and their homes have sold for more. But your right, for the most part, people can't stay quiet and the neighbors are a great source for the 'inside' info.
BTW, seems like you and Bryant are both a little country.. so what do you know?! ;^)   
(if you opponent thinks your weak, it just puts you in a stronger position.  What did my Carolina buddy call it? playing 'country dumb') ;^)  you aint fooling me Stan! :))
