eSignatures Are Now Legal in New York State!

We just received notification a couple of days ago, from MLS, informing us that eSignatures Are Now Legal in New York State!


I know eSignatures have been popular across the country for a couple of years but it's just now reaching us. We've lagged behind. Although ESRA (Electronic Signature and Records Act) passed in 2000, we were led to believe they weren't really legal for real estate transactions in NYS.

In any case, I'm ready to try it as I always read about how wonderful it is from other AR agents. It's just another great tool to help us run our businesses more efficiently.

Jill thanks for the update.. I would have thought that New York would always be on the cutting edge with new things.. but they took quite a while to get on board.

You would think but not necessarily so with real estate. It's the same with Buyers' Agents. It's finally reached us here but there are still a lot of people who don't understand it and don't see a reason for it. There aren't too many people using it yet compared with what goes on in other states.

Jill: I haven't seen it used much in Michigan either.  From an environmental standpoint, I think it's great to cut down on paper.  I wonder if fear of fraud-related issues hasn't hampered its more widespread use.  Hopefully it'll work out well in New York!  :)

Hi Jill. 

New York has moved in the right direction with the passage of this act.  My only only concern is that there are so few providers in this domain.  This could be the recipe for disaster
