Can I advertise my production after I leave my broker?

Last year you sold 65 homes - all by yourself. Most of this was done while you played golf, chased skirts and slept all day. You were a stud. A stud in your own mind anyways. Over the last 10 years you've sold over 1,000 homes with Get Down Realty. But all that's about to change. You've decided to pack your bags and go off on your own.

The first thing you do is set up a custom website. On the top of your site you type in big black bold letters..

 

 "Last year I sold X amount of homes, I'm awesome."

 

Never mind your slogan oozes with queso. Never mind there's a photo of you doing this kissing your biceps. What matters is the content of your real estate chant. IT IS NOT ETHICAL NOR PERMITTED.


Every closing you have belongs to your broker. You can't leave RE/MAX and then advertise your "closed" listings when you go to Century 22. You have to obtain permission.

 

Don't believe me? Call your state association.

Hi Kimo, Commenter #106. In this context, the Realtor Code of Ethics is using the word "broker" to mean seller's agent or buyer's agent. It is not referring to the Managing Broker or Principal Broker.

I agree that the varying definition of the term "broker" can be confusing! Thanks for pointing this out so it could be clarified.

We have a franchise here in the midwest (Help-U-Sell) that advertised ALL of the local area sold listings, no matter what agency sold them.  They send out news letters with the complete list and just a small disclaimer on the letter.   So an agent bragging about what homes he sold wouldn't surprise me.   I think each State has different rules governing this.  I love your straight forwardness!

Brenda #21 - There was a case in the TAR magazine that inspired this post. Like I said earlier, I think the Broker and the agent probably had issues beyond what you see on a day to day basis. Who knows. I guess it's always best to ask and not just assume versus apologizing later.

Greg, Great post in that it piqued intrest in everyone. We have a few brokers who use ALL the transactions in their office to boast they are the best and sell the most. I don't show my biceps, it would scare the children. ;-) fun post young man!!

Good info, Yep the production numbers come under Broker but I have never known a Broker to keep them from being tied to agent.

What a great post. I know an agent who had a lot of Property Management accounts and still listed them on her website. I am sure she didn't know of the rule or wouldn't have done it.

Greg - Great post.  I always enjoy the humor you interject into these.  And you are spot-on as usual.  Once you leave your current agency, you leave EVERYTHING you've ever accomplished with that agency.  All listings, closings, belong to the broker.

I can't say as I agree with this policy but I know it to be a fact in Oregon.  I never concurred with the idea that the relationships I cultivated were the property of the brokerage.  If the lead came from the company I could understand it but most everything I produce comes from my very own efforts, my sphere of influcence, the reputation I have built. 

In Oregon we are all called "brokers" but I don't know why they bothered with the change as it confuses the public and really did not change much about the way business is conducted.

"It is what it is" I suppose, but I don't have to like it!
