There are agents who actually believe the following is a deductible item for income tax purposes. 

What Do you say?

Manicures.

I don't like arguing with anyone on something like this..... but on tax issues you can't afford to be wrong.

There are other items that agents have told me they write off on taxes, like dry cleaning, beauty shop, etc..... I don't give tax advise and can't...but some of these are a no brainer.  Come on people.

I say I don't give tax advice because I am not a tax professional, but I would suggest running that by your CPA.

Neither do I, but just out of curiosity I did run it by him. He is a seasoned CPA. When I asked he almost cracked up. Said something about yes...if you are a fingernail model.

Next I bet you are going to tell me in a few years when I get hair implants and plastic surgery those aren't either. Boy, you are a real party pooper aren't you? I too am amazed at what people try to write off, but I'm sure there are crazier things than that if we ask an IRS audit agent.

Implants for a stripper will pass for the IRS... why not manicures for Real Estate Agents?

The IRS has argued that "grooming" is not deductible because it is a personal expense, regardless of the fact that it might "improve" your business. 

A stripper with the stage name "Chesty Love" argued that her implants were required for her business, and she won. She was able to write it off as an asset.

If manicures were an "asset required for business," only then could you write them off. So yes, a fingernail model could, a real estate agent can't.

Hi Trey, Shouldn't you be in bed sleeping?  Does this mean you are addicted to AR if you are posting something about taxes and manicures after 10 p.m.?   

As someone that has done taxes for a number of years, I've concluded that a number of people think they are writing off certain types of expenses just because they gave the expenses to their CPA.  That does not  mean that their CPA/tax preparer ACTUALLY deducted them.  When ever I do taxes, I sort throughly the items that the person reports.  Some are deductible.  Some aren't.  I can't fault them for including them, it never hurts to give more information than not enough.  But, in almost every persons returns that I do, there are things I ignore-for their benefit.  Even if it is reported, jst because someone actually deducts something like a manicure on a tax return doesn't mean that the IRS is going to say that is alright if/when they should to an audit. 

If an Realtor has an expense category labeled as "manicures" in the continuation/other section. there might be some red flags.  The IRS gets a LOT of tax returns from Realtors.  It knows what are normal expenses and expense ratios for Realtors.  Any person claiming manicures, as a Realtor, is BEGGING to be audited. 

Should anyone still be reading this long response- unless you are a firefighter/policeman wearing some sort of uniform that no reasonable person would wear as street clothes, the cost of your clothing/upkeep- to include nails, is not a business expense.  Exceptions might be exotic/strip dancers.  If luxury vehicles don't qualify, I doubt luxury nails will hold up. 

Note:  I am no longer a CPA.  I voluntarily gave up my CPA license last August 31, 2007, because I was tired of paying fees to be entitled to do work that I have never done- audits.  You do not have to be a CPA to prepare tax returns, do fraud examinations ,or sell real estate.

Trey,  Yes I know of a realtor who writes off their nail and beauty salon expendatures and their dry cleaning and buying new clothes.  Give me a break....NOT deductible.  Some people will resort to anything to keep from paying taxes....that could land them in a federal prison.

Kay you are right. You know there is a big difference between trying to cheat Uncle Sam and just coming up short. We all are pinching from time to time. Dad used to tell me. Pay the govrnment first, then  the bank, then yourself, then everyone else.

I have heard some CPAs who feel that they can justify a manicure as a business expense. You definitely want you CPA on board with grey area items like this because they will be there at the audit.

Reading all of this makes me laugh because every real estate agent I know, including myself, has written all of these items off and look where I am.... In an Audit with the IRS! NOT FUN!

My accountany just sent this over to me, I was in his office yesterday and he was laughing at my list of write offs. in my defense everyone in my office has been talking about being able to write off these same items. The scary thing is that i do have some accounting back ground, just thought i was missing out on an extra wite off. Do not wamt to go thru aniother audit, we had one last year and I am allset with meeting another IRS agent face to face ( my poor accountant) it was relentless and seemed to take forever. I will say though when i first started in Real Estate i di not have my hair and nail done weekly business was slow, I notice that the better i present myself the more business i get, while i will follow the rules I DO NOT AGREE WITH MOST OF THEM.
