LLC's in Missouri are required to have a local contact for their properties.... What?

We have all read about the licensing or registration of landlords and investors in many cities across the country. Kansas City, MO recently added a registration process. The form is about 8 pages long and just added yet another layer of bureaucracy to our already overtaxed real estate market here.

 But did you know that if you own real estate in the state of Missouri under an LLC you may be required to file an affidavit with the city clerk listing the person who has management control of that property.

 According to Missouri Revised Statutes Chapter 347, Limited Liability Companies -  Merger and Consolidation of Business Section 374.048.

 Any limited liability company that owns and rents or leases real property, or owns unoccupied real property, located within any home rule city with a population of more than four hundred thousand inhabitants which is located in more than one county, shall file with that city's clerk an affidavit listing the name and address of at least one person who has management control and responsibility for the real property owned and leased or rented by the limited liability company, or owned by the limited liability company and unoccupied.

 I'm not much for legalese but I have had to help some clients out with this. Seems some municipalities require that individual listed, to be a resident of that municipality. So as a service to our real estate investors and investment clients we often file that for them.

 Furthermore In order to know whether this applies to you, you would have to know if your property is in an affected area. The population part is pretty self evident, but what the heck is a home rule city?

 From Wiki Home rule refers to a demand that constituent parts of a state be given greater self-government within the greater administrative purview of the central government. In the case of some cities not having Home Rule meant things like Police and Firefighters could not get a pay raise without the state authorizing it.

 Most all of Missouri cities are governed by home rule now. There are, however; not a lot of cities with over 400,000 inhabitants located in more than one county. So that pretty much means they were targeting Kansas City.

 Interesting how they had to write all that to get around saying they require it in Kansas City, MO. Seems someone wanted access to the owners of Kansas City investment proeprty.

It is a new invensation about property law.Due to this a person will not be in problem because from one click you can sale property or purchace property.
