After completing a full color listing presentation and loading up my laptop for the online version, I headed to a competitive listing appointment. As I started the Comparable Market Analysis part of the presentation, the owner halted everything, claiming there was 2240 square feet of living space, not 1922.

 

I told her I pulled the information directly from the County web site and the Property Profile provided by a title company. My comps were in line with the County and that is what I had to go by. I also told her that if she were to say the property yielded 2240 square feet of living space and she received an offer based on her square footage and the appraisal came in low, that would present an unwelcome and uneccessary set of circumstances.

 

I asked if her and the husband had measured the property to confirm the larger square feet of living space and her answer was no. Had she ever had the property appraised to confirm square feet of living space? No again. She bought it from someone who offered seller financing, a FSBO. I told her that I must adhere by County standards unless she has proof otherwise. Our industry is based on accurate information, not hearsay. I was unwilling to use the information she provided and did not get the listing.

Interesting.  Did the owners have an appraisal when they purchased???  If so, what did that say???  If not, where are they getting their information??

I'd have been tempted to do a gross outside measurement FOR MY OWN INFORMATION.  But, that's only because I'm always curious.  I surely wouldn't rely on the measurements.

It is interesting how many people are clueless on the actual size of heir home. As one who does BPOs it is interesting the number that have an appraisal with different sq ft totals than the County.

Lenn, No appraisal was done. She purchased it through seller financing. I looked further into the history of the home and the City records say 1350 square feet. The house has 5  bedrooms, 3 baths...County records state 3 bedrooms, 2 baths. Perhaps a floor plan was initially submitted and they changed the square footage without notification.

Gary, It makes me wonder why, if she knew her square footage was greater than the County records stated, she didn't change it before putting it up for sale.

Oh no Will! Hope she makes the commitment to you eventually!

They need to have an appraisal and take it to the county.  Or, it's possible there is an addition without a permit that would have registered the additional sq.ft.  That wouldn't be a problem if they have an appraisal.

Lenn, I recommended that she get an appraisal. Eventually  the true square footage will be known.

Wanda you are better off without that listing.  That could be a lot of legal trouble for someone.

Wanda well it's not your problem anymore, thankfully. And now, whoever they listed with is 'taking their word' and advertisting as such. Disclose Disclose Disclose.....that will rear it's ugly head at some point. And it should.

Jim, I agree. It is not feasible to put something in writing that has not been proven.

Never ceases to amaze me.  Guess this is why, after almost 25 years, my wife who's the active Realtor in our company has just picked a niche and represents specific active Investors or Flippers.  So she avoids things like this, just wore her out!

Wanda, it couldn't possibly that an owner lied about the square footage when they were selling house is it? That would be so uncommon.

Wanda, you are doing the right thing.  Misrepresentation will open everyone up to potential litigation that can be costly but is always time consuming.
