Giving those that don't give up, all the credit in the world. I hate when I speak to a client that is trying their hardest to stay above water. Trust me, I am a firm believer that good things do come to those that are good, true to themselves and others, and help others. But there are just sometimes when you act good, being a good person in general, that bad things will just happen to you.

I spoke to a client yesterday that had to file a Chapter 13 bankruptcy around May 2007 because their pizza store went out of business. They happen to live in a very good town, have 2 kids, and seem to be hard workers. They filed bankruptcy to save their home and to try to get out from under a bad situation. What's even sadder is that they have an adjustable rate mortgage at 9.87% which is adjusting in 2 moths. Knowing some of their situation when they got their last mortgage, it seems that they could have received a rate about 1 1/2% less, especially since they had plenty of equity back then and good credit then.

This couple is struggling and I might not be able to help them. One main reason is because their current mortgage is about $30,000 higher than the maximum FHA loan amount for their area. Hopefully this wil change sooner than later. At this time, we have debt to income ratio issues also. But this couple has proven to me that they are trying and deserve another chance. The husband is not only working full time at a restaurant, about 60 hours a week, but working part-time on the side. The wife, besides taking care of two kids, works part-time as a supervisor, 20 to 30 hours a week. She also delivers a paper once a day in the mornings, just to help out with their bills.

As I talked to her on the phone, I could sense that she was frustrated and I could hear tears over the phone. It was just her voice. I felt angry and frustrated as I listened, even though I couldn't relate 110% to her story. I have heard many stories like this one in the 15 years that I have been in the mortgage business and these are the type of people that I certainly love to help. But I am not sure what I will be able to do and we are looking into a few options.

 

 

 

Overall, I just wanted to share this story with everyone out there. Just letting you know that if you are going through some of the same issues mentioned above, that you aren't the only one. I don't want to place fear into the minds of so many out there, but just do your homework when working with a loan officer, no matter if you are purchasing or refinancing a home. Not dealing with a true mortgage professional could come back to haunt you down the road.

Jeff:  I feel for your clients; and, I do agree wholeheartedly that you MUST chose your lender wisely.  Thanks for sharing...I hope that find a way out of this very soon.

Jeff,

I would really like to understand this better.  How did this couple get into this spot?  Did they stretch their buying ability to get into a house?  Did they get bad mortgage advice to begin with? 

In my practice as Realtor, I emphatically advise buyers not to buy the house they can, but the house they should.  Did another agent push this couple to act against their own best interests?

Thank you for all you can share.  Although I do not currently have any clients with this problem, the difficulty that people have with their mortgages effects us all.

9.87% YIKES!!! Are they in a predatory lender situation?  Sounds like they have been piled on, and every-time they turn around they get broadsided again!  Have they spoken to their lender?

Recently I had a home listed with a young couple who were in the same situation except they did not have a business.  The bank was foreclosing, we could not sell the house, so they let the bank take it, found a nice rental and are now in credit classes with another lender to help re-build their credit and work towards home ownership again...this time with a lender they can trust.

Good advice...not everyone who works for a lender is a mortgage professional...consumers need to do some 'due diligence' before they choose a company that has their best interests at heart! Thanks,   Fran

DEBBIE.....  thanks for the concern. I hope that I am able to find some type of solution.

 

JOY.....  well, I I did mention that they lost their business. Because of this, it brought them to the situation that they are in now. And it was hard for the husband to find employment. It took about 2 months. And his income is considerably less than what they were making prior, when they owned the pizza shop. So, right there, a loss in income would definitely put you behind the 8 ball per se.

Overall, from what I can tell, nobody pushed anyone into anything. But I will say this, they probably could have gotten a better mortgage program with a better rate. Even though I don't know exactly what their credit score was at the time, it was much higher than now and they had a good credit history back then. They did have to go stated, but I would say that they got bad advice and a bad loan from the previous lender.

MATT K. .....  well, maybe working hard isn't enough, but at least this couple isn't throwing their hands up in the air and just walk away from their house, like so many.

CATHY & GARY.....  I kind of explained some of this to Joy, in my comment above. It certainly is a subprime loan now, with a stated income program. And just from my experience, I have seen some people that were told to go stated, because they were self-employed. But the lender never bothered to check the clients income. I had one referral last year that was in processing with a lender, a stated loan, with a higher rate. I asked for his tax returns and took him full doc.

MISSY..... you are correct. I feel sad for many, but as you stated, it truly doesn't hit you until you speak to someone.

MATTHEW....  thanks for the polite compliments. I know that both you and I see eye to eye on this subject, especially since you write about it often.

FRAN.....   I totally agree.... it's one thing to make money off of someone, but another when you mislead the consumer or give bad advice.

Jeff... It is unfortunate and sad but we cannot fix everything. As tough as the financial situation they are in feels it can always be worst... If all else fails your prospect can always sell out and start over even if in means renting for awhile......

Not implying this is the situation here at all, Jeff, but I'm reminded of the expression "Penny wise and pound foolish."  It always pays dividends to work with a true professional, in any field, rather than the guy who promises the moon and delivers swiss cheese.  I only wish these folks had found you earlier.

Jeff, I am one of those who doesn't watch a movie when I know the ending is going to be sad.  But movies are just stories that you don't have any power over.  The real world is full of stories where people have trials and somehow get through it, and thank goodness for good people that are there to help.  Thanks for being one of the good guys!

ANDREW..... it could be luck, bad luck, just a bad day, a bad year... but you just need to stay positive, work through it, and move on at times. Health and family should be number one on list first.

PAUL.....  thanks for the kind words. And I agree with your statement. I just can't stand it when a loan officer takes the easy route that could end up hurting the consumer or give them a less than good deal.

SHARON.... yes, movies are just that, not real life. And they have control of how the movie turns out, but not in the real world. Sure, you can control your own destiny at times, not not always. Thanks for the polite comment.

That Book you pictured is an excellent READ !!! Does your state have a Foreclosure hotline like IN does ?? - ( I posted a Blog about it awhile ago) the banks/lenders do not want the house- they are willing to work with people like this who are struggling with several jobs to make ends meet).
